Ridiculous legislation

Two weeks ago some b******** collided with my boat while it on its mooring causing £2000 worth of damage. Having read these regulations it seems pretty clear that I should report the incident, so I have just phoned the Coastguard to find out the proper procedure. They have never heard of the new requirements, and refused to believe that anything could be so daft.

you could try to get out by saying you are a subject and not a citizen (as is anyone with a king or queen as far as I know), but I dont think you would get away with it!

As far as the term accident goes it is defined as

"any accident or occurence affecting the saftey of a ship, including, without prejudice to the generality of the foregoing, any occurence wherby a ship-

(i) is in collision,

(ii) grounds,

(iii) is damaged,

(iv) malfunctions or breaks down,

(v) suffers the flooding or shifting of cargo,

(vi) suffers a defective hull or structural failure;

An incident means any incident which affects or could affect the safety of a ship or other ships, including, without prejudice to the generality of the forgoing, a failure or defect which affects or is likley to affect -

(i) the manouvrability or seaworthiness,

(ii) the propulsion system,

(iii) the steering gear,

(iv) the electrical generating system,

(v) the navigation equiptment,

(vi) the communications system,

of that ship



could a calm day be considered an incident which affects the propulsion system of a yacht?

when i pour hot water into my smash or my pot noodle, is that an accident wherby I suffer the flooding of cargo?

so what if I fall from the mast and break my leg or if I have to rescue a MOB? according to this I dont have to do anything.

Why is a serious injury like this less worthy to be reported than a flat battery, after all, this rediculous legislation is primarily about safety at sea.

also, the terms "accident" and "incident" only apply to ships, so does that exclude yachts by default?

if it doesnt, then should I report when my radio controlled yacht collides with a duck, or when i get interference from another operating at the same frequency

If the helm falls over then isn't that a failure or defect in the steering gear and thus should be reported?
And when the first mate goes to sleep that is a defect in the communications system?!

My understanding is that original wording excluded leisure craft, and the consultation was based on that wording.

The MCA subsequently changed the wording to include leisure craft

This would almost certainly be done by the in house job creation team with express purpose of generating unnecessary work so as to allow recruitment of more staff with appropriate promotion for all as a result.

Best action would be to ignore it completely.

There is going to be a General Election in about 4 months - well before the September date.

What we should do is to make sure that we verballyassault every prospective MP at every possible opportunity. Its the only time theres a chance of them listening.

Public meetings are best.

Use the job creation, waste of public money line.

A snowstorm of silly reports will only play into their hands, they'll just recruit more people to deal with them - which I think was the original objective.

Good grief. Someone resurrects a months old thread, and people are responding to it like it is todays news.

The problem has gone away, it's been overturned (well, it's going through the process of being overturned), or had no one been reading the updates on the situation?

You are not the only one - Paul Lomax himself (the website administrator) confused member registration date with thread date only days after new forum went live /forums/images/graemlins/smirk.gif. Only today, someone resurrected a 2002 thread. I'm having to train myself to look for the date and time thread/post posted, cos I keep looking at the member registration date instead of post date (like Paul)
