Red diesel continued

so after my last post about is red diesel dead and have the RYA given up I see p140 of PBO where Jake Kavanagh suggests there is light at the end of the tunnel in the form of HMCE suggesting that only exceptionally can 2 tax tiers exist.

Is anyone aware of what qualifies as exceptional ?

is HMCE playing nicely and offering a lifeline...out of character maybe but fair??!!
 
HMCE's own paper to the EU spelt the nightmare out - now they are stuck with it and they know it will not raise any more money - they have to make the best of it and it will be impossible to police buty the threat of say losing your boat may do it.

Well the private flying lobby are trying to get a special status for their AVGas, 'cos it's high octane and only made in small quantities (relatively), pity the RYA and BMF don't join forces....
 
There's a thread on one of the other forums, to the effect that red can be retained at the pumps, thus saving cleaning the tanks out.
Possible down side was white diesel is ULSD (?), red is not, so is subject to a higher tax band, as it's not as clean (green ).
Or similar.

[/ QUOTE ]That's my take from the document too. In reality, how many will actually evade?

In my case for example .. the gain would be too small vs the consequences if I got caught out.

A big fuel user, maybe more difficult to lay hands on enough low-duty Red without questions being asked. Maybe more likely to get caught by discrepancies in fuel bills vs engine hours or something.
 
I think there will be very little if any chacking - just the odd bit.
It would be almost impossible to prove use by engine hours ete - the consumption is so variable depending on speed and weather etc. So I think the main control will be the fact that unless you are commercial you will just not get it cheap at the pump - outside that there IMHO will be little control just the threat of losing your boat.

The intersting thing will be just what you have to show to prove the commercial status.
 
There is currently virtually no checking to see if people's boats are CE Marked, which means there are lots of technically Illegal boats out there, let alone the catalogue of dodgy fit-outs which exist as a result...

With this in mind, I doubt the government will be able to find a huge amount of time to go dipping boaters tanks...
