I bought a Es127 of someone that said it was new but surplus to his needs , He forgot to mention that the unit had been back to Raymarine for repair , in effect used ,anyway on sending it back this is Raymarines reply

What ,if any rights do I have ? The unit is 35 month old and technically scrap.!

Please see below the engineer report/estimate for the ES127.

Tested and confirmed screen jumps. Unit has suffered touchscreen failure. LCD needs replacing but spares are not available so a repair is not possible. We can upgrade the display for a new Axiom Pro 12 RVX under the fixed price repair charge if agreed. Cost is £950.00 excluding postage and vat.

If you bought this as a private individual from another private individual you have less protection under consumer legislation than if you had bought it from a company.

The protection you do have is that the item must be "as described".

Do you have a copy of the advertisement you responded to?

No it was via this forum verbally ,nice bloke who was very helpful in getting bits to Italy where it was professional fitted .looked brand new in its box.
 
How much did you pay for the goods. If it was £20 I'd put it down to experience. If it was £100 I'd make sure that I had a copy of the advert then ask nicely for a full refund.

If you don't get a reasonable offer after a few email exchanges I'd threaten a full refund plus your costs or County Court action.

If you don't get the full refund plus costs within 7 days, then I'd file a claim.

Err, it was part of a complete autopilot system coming in at a couple of thousand pounds.

I've no idea how I was supposed to know that ..... I thought that the "For Sale" forum on here had a pretty low limit. :confused:

However, none of that makes any difference to my answer. It's negotiations over a full refund followed by court action, if required.

You could buy a brand new Garmin 950SV complete with navionics chart for less than that.
Why not just go for the smaller model & change, or pay a bit more for a new Garmin of the same size. It will still connect into NMEA 2000

Well if you have nothing in writing describing what was offered, you are in a weak position when it comes to proving you were sold something that was not "as described".

But I suppose your starting point would be to contact the man who sold it to you, state your complaint and see what, if anything, he is prepared to do about it.

If you are unhappy with his response, or don't get one, then you must decide what to do next.

I wasn't being rude to you ,I was unhappy with myself . I bought the items from a forumite who was very helpful ,I understood the items were new to him ,but surplus to his requirements ,at no time was I told it was a refurbished item ,I am a uncertain how I could prove this in a court. It was around Nov 2017 and worked perfectly until June of this year when it would dive off course and the screen showing a map of America ,sometime Africa .The first time I noticed was when I hit a rock off Aegina somewhere I have sailed for 20 years.
 
I'd take Raymarine's offer of £950. Sounds like a bargain to me.

Yes, it does ,around £2700 under retail price. But do I want to deal with a company that's products are obsolete in 3 years.
Is there some sort of Eu rule about length of time parts are available.

Hang on a minute. You bought this in 2017 and it worked perfectly until this year. So you have had two years use out of it.

Your case gets weaker by the minute!
 
I am not sure if your complaint is against Raymarine or the person who sold you the mfd that has become faulty after two years.

Ah .... sorry about the misunderstanding. :)

I have to agree that the new information changes everything. For private sale purposes it's now definitely too late to pursue matters in law. There would be no harm in contacting the seller and advising him about this new information from Raymarine to see if he is prepared to offer some redress but that's about it I' afraid.

As to whether you should take up Raymarine's offer, it sounds like a good deal but I don't know enough about modern equipment to comment.

Raymarine standard warranty on new items is two years, extendable to three years online. Items bought from then as refurbished have a two year non extendable warranty. I don't think you have any claim after two years for a second user item, although you have been unlucky.

I accept that it to late for legal redress ,however it was only this week that I was informed the unit was refurbished ,as I was lead to believe it was a new item ,no longer wanted .

The second part of my whinge is this Chart plotter that was a top of the range item, is now obsolete in 35 months, with no parts to repair it .

Caveat Emptor,the principle that the buyer alone is responsible for checking the quality and suitability of goods before a purchase is made.

Does this apply to all new Raymarine products? 35 months and no spares sounds as though they new they had a duff product that was going nowhere!

Will this effect their reputation or is it shot already?

I think I accepted that the seller of the item is not responsible .It was others suggesting taking legal action. I haven't even contacted him directly.

What I feel more important is the fact that a manufacturer of a very expensive item e s127.
Chart plotter do not carry parts to repair 35 months after it was made.
The internet pages are full of this Raymarine screen freeze problem .
