Martin, from the 2 letters it sounds like MPE accept that they (not SSL) owed you the £300. They say now that they discharged their oblig to give you £300 by giving the money to SSL. But they can only have discharged that obligation if SSL were your agent or if the warranty terms sed that, both of which I doubt.

Again, not sure I have all the jigsaw pieces but you should claim from MPE. You need to write a strong letter but crafted carefully saying the following. Word it carefully, make sure anything legal is technically correct, so MPE bods can see you know what you're on about and will not mess with you, otherwise they will treat you like most others and fob you off

1. They owe you under the wty. This is direct, your wty is with MPE not SSL

2. They agreed that by their actions, ie the letters and the fact they gave the 300 to SSL, intended to be forwarded by SSL to you

3. Their giving 300 to SSL in no way dischrges their 300 debt to you, so they must send you another 300

4. How terribly sorry you are they have given 300 to SSL who went bust, suggest they contact the SSL receiver to ask for their 300 back (sed with a "touche" smile)

They will reply no I spose, then send letter before action.

Will bash of letter tonight and keep you informed of progress...wish I knew the guy that lost his whole engine claim..

I will try to remeber to look at my warranty papers tonite or over the weekend, to check the warranty point. I forgot to do it last nite, was late home. I have the papers from buying merc outboards in 2001 and 2000, so they should be close enuf to your paperwork. Will post more, if they shed more light. Good luck
