out of date flares illegal in France?

So I read in YM. I have always kept the old ones when I get new as they are reported to still work and in an emergency the more the merrier. Although that horrific accident a couple of years ago makes me a bit nervous about using them.

So are they illegal in France if you have in date ones and keep them as a backup, or are they illegal full stop? And which other countries have this policy?

What would they be called - Le Gendarmarie haut couture?

But seriously I must take my out of date pyrotechnics down to the local nick if they'll take them.

Got the following response from the RYA last year when I asked the same question...

"Dear Mr Vibert

I am attaching a copy of page 17 of the RYA magazine from Spring last year, in which we reported on this subject. We have never succeeded in obtaining written confirmation from the French Authorities on this subject, however we have also never heard of a case where anyone was actually fined for having out of date flares on board. Although reports at the beginning of last year, suggested this had been the case, in fact a fine was only threatened and in general where the French do fine UK Yachtsman it is because they do not have their original ship registration document available for inspections which you are required to carry.

I have heard stories of boats being subjected to a find in France for carrying out of date flares as well as in date ones probably best to check with French authorities to get it from the horses mouth so to speak
