Medway boats damaged in fog 28/09/14

From what I've heard the owners of the boats involved had an up hill battle on their hands getting the boats fixed.

'Betterment' seems to be the issue, your well maintained boat has had the rig torn out of it and needs a new mast.....you need to pay towards it etc.

Plus anything up to 12 months of lost use for which you're not compensated.

Nothing like say car insurance - here's a courtesy vehicle and yours will be ready by next Friday.

Nothing but sympathy for the owners involved.
And the Pilot who should have stayed along side, due to the viz, just had to go for some "training" rather than getting the sack
 
Its the ships master who should have made the call to stay alongside or to continue under the guidance of the pilot.The pilot advises the master who always has the ultimate responsibility.
As for the compensation wrangles,I wonder what would be the upshot if it all went to court.Would the courts accept the insurance company underpaying due to "betterment"?
