Medway boats damaged in fog 28/09/14

She has a discharde conveyor on the Stb side that should be stowed when under passage. It is about 20 m long so it could take out all the rigging without touching any hull. But you would have to ask.. WTF is someone doing leaving it sticking out?

it was the port side bow that did the damage. It woke me up, and in the time it took me to wearily get out of bed, and go the companionway hatch, the stern was just passing the yacht.
 
He doesn't need your permission...

I'm not bothered and not interested in being credited for them but it would be nice to be asked, seems a gentlemanly thing to do.

i wouldnt mind anything to do with boating sites or yachting press to use the photos but i would mind kent news or other such places using them without permission.


also so sorry to see this happened to the great members and people at MYC. stayed there last year for the night and its an amazing club. those dredgers are huge and i have had visions of them crashing into our moorings at erith yacht club in the dense fog
 

Ok, that's a clear violation... They have lifted the images from Facebook, and the material has been placed on Facebook via someone calling himself "kent_999". Who has clearly just lifted the images from here... And the licence we agree to here does not extend to syndication for Timeinc and it is not a licence which would allow third parties to lift the material...

Kent_999 has simply stolen the images and out them on his Facebook page, and then kent online has stolen them again...

I would report the infraction to Facebook, who have a reporting function, and should stop it...

As well I would fire off a email to kent online informing them of their infringments...

Which btw are as follows...

2 primary infringments under sections 17 and 18, Copying the work and then issuing copies to the public.

2 secondary infringments under section 23 and 24. Possessing and dealing in infringing copies, and providing a mechanism for the production of mOre infringing copies.

2 further infringments under part 4, Namely section 77 and 84, your right to be identified and false attribution..

Further because they have committed the secondary acts as part of their business the "officers" of the company have committed a criminal act under section 107 and can be held individually liable.



You've taken images which are yours. You have the right to decide how they are used. Some ****er with a Facebook account doesn't, and Kent today are just taking the piss. I would contact facebooks abuse email and get them pulled...

If you are happy for kent today to use the pictures I would contact them and insist on a change of byline to ensure you get credit.
 
This thread has reminded me of spending nights on the outside moorings at Pinmill and being woken by large ships passing up the Orwell towards Ipswich, I remember at the time being very impressed by the skill of the crew who were able to pilot the, relatively enormous, ship so that it missed my boat by a mere 20 foot or so.

Was I wrong to be impressed? Or are they usually pretty good at missing moored yachts?

I also remember many years ago a large timber ship trying to come alongside Baltic Wharf in the River Crouch and steaming right into Essex Marina, evidently their gearbox failed and they could not stop in time. It was a sunny Sunday morning and a number of boats were damaged.

damage has happened in the past @ Pin Mill & Ipswich above the bridge

Not that who's nicking the photos off here and reposting them is of any consequence to the club members effected by the incident.

The sterling effort of the club bosun, his team and our members combined have already got a crane in to lift the damaged masts and get the boats ashore.
 
I seem to remember that Ipswich APB put out a local requirement for leasure vessels on moorings with crew on board on the Orwell must show an anchor-light overnight. This was after a strike by a ship.

Wasn't made aware of that when I took on a mooring at Pin Mill although I do leave an anchor light on regardless if I am onboard or not. Not sure how much good it would be in thick fog.

Me too, although I sleep a little sounder knowing how little water there is around my supposedly 'deep water' mooring these days.

...and send them a hefty bill (which I'd certainly do if they were mine...used to be a pro photographer). If you've no wish to keep the money, the victims of the Arco Arun might welcome a contribution to a fighting fund, judging be the apparent attitude of the dredger's owners.

Not sure what good it would do anyway, as on all occasions when ships have hit yachts on the Orwell - and there have been many over the years - they have claimed to have had steering/engine failure or some other reason for loss of control. If that was the case how could they avoid a yacht that happened to be showing a light?
 
Was a report ever released about this event? I can't find anything on the MAIB site not even under discontinued investigations.
 
The Arco Arun incident on the Medway was investigated by Peel Ports and their conclusions were not made public, although the MSBA was told that the pilot was sent for retraining. The MAIB were not involved, presumably because no-one was hurt.
 
There are many MAIB reports where no person has suffered an injury. It seems a bit of a coverup to me. I reckon it might not have been reported. Thanks for the info though, I might be able to find out a bit more now I know who to ask.
 
Mistakes are made and incidents happen, that's life. What generally makes the difference is how they are dealt with afterwards. Does anyone know if the owners of the various yachts involved came out happy with the way they were treated or did they have to fight for everything....?

From what I've heard the owners of the boats involved had an up hill battle on their hands getting the boats fixed.

'Betterment' seems to be the issue, your well maintained boat has had the rig torn out of it and needs a new mast.....you need to pay towards it etc.

Plus anything up to 12 months of lost use for which you're not compensated.

Nothing like say car insurance - here's a courtesy vehicle and yours will be ready by next Friday.

Nothing but sympathy for the owners involved.
