Kent boaters fined for sailing around the registration

Two men have been ordered to pay a combined amount of over £1,150 for illegally using their vessels on the River Medway without valid registrations.

Lyndsay Beadle, of Barnsole Road, Gillingham, pleaded guilty and was fined £135 with costs of £115, a compensation order of £340 and victim surcharge of £20 at Maidstone Magistrates’ Court on 5 February after failing to apply for a boat registration. His vessel “Fortuna” was seen on 24 June 2014 at The Riverside Moorings, upstream of Allington Lock without a displaying valid Registration Certificate. Mr Beadle was made aware he needed to comply with the Environment Agency’s boat registration requirements, however he failed to do so.

Also at Maidstone Magistrates’ Court on 5 February, Mr Gordon Marshall, of College Avenue, Maidstone, pleaded guilty and was fined £115 with costs of £115, a compensation order of £291 and victim surcharge of £20 as his vessel “Carleys Pride” was used without a valid licence. The vessel was seen on the Medway Navigation at the rear of College Avenue without a valid registrations displayed. Environment Agency records show that Mr Marshall had submitted the registration application, but had failed to provide payment or a compliant boat safety certificate. A notification was sent to Mr Marshall in July 2014; despite this no registration or fees were received. In his mitigation Mr Marshall apologised to the Court and said that the oversight was his responsibility.



Rebecca Cox, Environment Agency Waterways Officer said, “The revenue we receive from vessel licensing is essential. Without it, we are unable to complete our annual maintenance programme such as lock repairs and dredging, and providing facilities like moorings, toilets and showers. We are lucky to have such a popular and well known public right of navigation in Kent that is enjoyed by so many. By not complying, the revenue is lost, threatening the future of this great waterway.

“The Environment Agency carry out regular patrols on the River Medway, so owners of boats not displaying valid registration plates could face prosecution. It is important that they are aware of and adhere to this requirement. Ignorance is not an excuse.”

Well done EA ...regularly passed one of those particular boats on our travels up to East Farleigh !
Hopefully other defaulters will get the message.
 
With the EA I am not always clear quite what we pay for. But if we are going to pay then everyone should pay - and they [EA] should be rigorous in collecting the fees.
 
Wow that Sergeant Brookes derserves a medal, some people just don't think the law applies to them. I notice at no point in the video did he claim to have paid his license.

There's a huge thread on canalworld.
The owner who was not present - but sent a mouthy representative instead - claimed that he didn't need a licence as the was not moored in the 'main channel'.
There is some law for rivers other than those controlled by EA.

The poor seargeant really deserves a medal - he could so easily have arrested the Mouth for obstruction. While all that was going on the lorry with the NB onboard quietly drove off.
 
Is this referring to the disc or something more significant? Seems like a rather stiff penalty for not having a £50 disc!

I thought the best bit was when the mouth said he was entitled to arrest the Sergeant for aiding the theft of the NB, priceless... Four years unpaid license allegedly.

Freeloaders always seem very aware of their rights but show little regard for anyone else's. The mouth would make an excellent barrack room lawyer.
 
You don't pay your licence you lose your boat,perhaps the EA should follow this.

Feel sorry for the police and the boatyard who just wanted to get on with some work!

Seems fair to me, isn't that what they do with cars parked on the road without appropriate tax paid. Far too many freeloaders around these days (Harlow seems to be being over-run by gypsy caravans at present, which is winding me up no end!), if they don't like the thought of their boat / car being seized they shouldn't moor / park it where a licence is due.
 
It's too easy to get a licence and too many think it's a licence to squat. If the EA were more selective, the council wouldn't have been forced to make changes to the by laws at great expense to the rate payer. The only winners so far have been the squatters and the legal teams. I noticed a few gaps in Teddington where a number had been moved, only to relocate less than half a mile up river and become someone else's problem.
 
Yes. Luckily I was at work so watched all 54 mins :)

Basically jumped up, self important ill informed knob and cronies spent a long time telling the police sergeant how to do his job, whilst trying to come across as an aggrieved victim who'd done nothing wrong.

He owed four years licence and about £8k in marina fees. Hence his boat was seized.

The police officer was ultimately not arrested by the **** or any of his loud idiot mates.
