We decided to move Alice a new home, closer to home and mentioned to MDL that we may be vacating our berth, OK they said we'll calculate the refund, now what we do because you want to terminate the contract is turn you into a temporary berth holder and take off all the discounts.....

So we owe you three and sixpence to not be here until April.

That is just brilliant. I would laugh, but I am pretty sure you would smack me in the mouth if I saw you again.

What sort of medication do you think MDL are on?

PS, I presume you have told them you aren't moving until April after carefully considering your options?:p
 
Just downsized the boat by 2.5 metres with 6 months to go on our current contract at a Premier Marina. Got a full refund on the size difference for the remaining 6 months, and I'm in the same mooring. Fixed price till 2013 (but of course I've had to pay them up front, but the money's worthless in the bank). Beat the VAT increase for two years. Oh and I got a years free insurance on the new boat.

Seemed like a good deal to me.
 
I'm not an apologist for MDL,but that is in the small print of the contract and certainly influenced the date we left for sunnier climes. And now we are in sunnier climes (Spain), the same conditions apply!

Indeed, it's there and that's it, well over 90% of the anual berthing fee is over the summer season, so really it's berth here for the summer and get the winter free!!!

You will find similar logic being applied if you ever try to cash in a Railway season ticket before it expires.

Thats good compared with Premier..............

You sign for 12 months and pay/owe for 12 months.

Say you leave after 1 month you still owe for all 12 months.

If the local marina manager finds someone else to sign for your berth for 12 months then they let you have some money back
BUT

Why would he do that, he has a target to hit and it is in his interests to let another vacant berth he is not getting paid for.

Even if yours is the last berth he has why should he get someone to sign for 12 months on it, it is more in his interests to let it out monthly in effect getting paid twice for it.

Has anyone been paid back by Premier ?

There is a loophole in that you can switch marinas, so best transfer to the cheapest Premier marina in the country with a 7 meter boat, get back as much as you can and then leave.

Actually, Premier's Ts and Cs work on the basis of paying the lower of the annual fee and the daily rate for the period of occupation - which I think is the same as Ian found at MDL.

I moved from Chichester Marina four months into the current berthing year and even then the annual rate was less than the daily rate for 120 days so it's slightly academic.

I have to say that I knew that was in the contract when I signed and I also knew that because no set berth is guaranteed, even if "my" old berth is filled it wouldn't mean I was entitled to a refund. I actually spoke to the marina manager and said that I wasn't expecting anything but if they could fill the space, could I have something. He said he'd look into it. I'm not holding my breath but it would be nice. In fact I've just emailed to ask if they have had any luck in putting a smile on my face.

Overall, I have plenty of time for Premier. I berthed with them for 9 years and enjoyed the experience. I would happily do so again, in the right location. I can't grumble if they stick to the terms of a contract which I went into with my eyes open.

I agree the MDL contract reads like that but I would be interested if you have read the Premier Contract recently as you indicate a recent change, it is not my recollection that the wording allows for a pro rata charge UNLESS your old berth is let to another 12 month berth holder.
Taken off the website today but the contract contains (used to at least)the extra terms as above.


Pro-rata refund if we are able to re-let your berth

You can claim a pro-rata refund of your berthing fee if you leave Premier Marinas and we are able to re-let your berth.

Wonder what would happen if you got a mate from your marina to insist he moves into your empty berth ?
 
I believe that MDL will hold any credit on account at the full rate which can be used over the following 2 years. When I left OV a couple of years ago in August, I took that option and 2 years later the credit paid for a year's mooring. Worth considering?

Hi DAKA, I've just cut and pasted this from the current Premier Terms and Conditions:

"8 TERMINATION

8.1 The agreement shall start on the Start Date and shall continue until the End Date unless it is ended earlier in accordance with this agreement.

8.2 If you have a 12 month berthing contract you will have been given specially discounted berthing rates for committing to that 12 month period. Therefore if you end the Agreement within that 12 month period the berthing fee for the period of occupation of the berth will be recalculated and the amount due will be the lower of:

8.2.1 The number of days of occupation charged at the daily visitor rates: and

8.2.2 The full amount due under the 12 month berthing contract."

Tried that. that only works now if you change boats

Thanks for that Benjenbav, clearly new as the premier website still suggests otherwise as per my copy paste above taken earlier today unless the Premier advantage actually intends to offer true pro rata rates as long as they let your berth again.
