Loopholes in Loophole?

There has been a lot of interest in the press regarding the chap off Hartlepool selling Booze and Fags beyond the 12 mile limit. Well latest news, C & E arrived this morning with artic lorry, everything aboard being removed as I post. Will be interesting to see what happens when all goes to court. Mike

Hasnt he been running out of a UK port, with his boat stuffed full of goods (big mistake)? This would give customs the loophole to grab him with the "reasonable quantity" requirement. Whereas if he had stayed outside of the 12 mile UK limit, I think he would have been OK.

I have to say good luck to him.

The tax and duty situation we have in this country is ridiculous. Its not even as if the tax etc was spent on "good works" which i'm sure we would all suport but instead its wasted on inefficent beauracrats.

Does anyone know if his boat was the Rich Harvest that was on the hard at Holyhead for a couple of years?

not sure that was the case Mike as we are based in Denmark but when we sail offshore, we can purchase cigs and tobacco at full duty free prices. Around £10 for a carton of 200. I think that was the case here too. Problem is that you can only have one opened 200 carton in your possesion when you return to shore, or big fines.

I would have thought that he could have put his D/Frees in bond... like aircraft and presumably ferries etc do when they arrive in the UK. He would have had to have his 'stock' in a cabin that he could seal off and secure with a customs seal. I presume that HM C could have supplied the appropriate paperwork..

Good luck to him.. but every time someone dodges one tax ... you and I have to pay a bit more on our PAYE to subsidise it ........ PAYE we are like the Poor Bloody Infantry, always get clobbered and no way out...!

I suspect that as it was all duty paid in Germany C&E would not allow it to be placed in Bond. If C&E lose the case, then there could be a lot more doing the same thing.. With luck possibly lead to a more sane approach to the tax on booze.
