This Saturday I was on the foreshore of long island when I was told that I could not land as it was private property. The chap that told me appears to be living on the island in a barge and told me he was acting on the instructions of the Rempstone Estate. I argued that I didn’t think they could stop you landing between the mean high water and low water marks but he disputed the fact and I had to leave. I consulted Ian Bishop, the deputy harbour master of Poole harbour this morning and he confirmed that you can definitely land on the foreshore up to the high water mark. Another interesting fact is that the barge on which the groundsman of the island lives on, is allegedly moored there illegally. Although I can understand the Rempstone Estate wanting the island for their own pleasure, this must not interfere with the rights that so many families have enjoyed for umpteen years and although a few people tend to abuse the island, lighting fires and leaving rubbish there ( which I have picked up on occasions) this is not justification for the few to ruin the enjoyment of the vast majority of responsible boaters.
 
This Bournemouth Echo story gives some details, Press Story the main issue seems to be that Rempstone Estates want to sell the Island and the fact that large numbers of the public have been using the it. I would be interested if anyone knows the position regarding the right of way application.
 
This was mentioned in PBO (the around the coast section of I believe the May issue). I don't have it in front of me but from memory Dorset County Council wanted to hear from people who have used the rights of way on Long Island over the years so that they can enforce them. Does anyone have that issue (the one with "Start 1st time, how to service a 2 stroke outboard") to hand so we can get the facts straight?

Many (many) years ago I rented Green Island in Poole Harbour, for a holiday (can't do that any more) and was told that we had no right to keep people off the island below the high water mark - only above it.

An application for rights of way on Long Island in Poole Harbour to be recorded and protected is being considered by Dorset County Council (DCC). The island recently came up for sale and some regular walkers were challenged on one of the footpaths. DCC can ensure that the public has access and that the paths are maintained only if enough evidence of their continued use over the past 20 years or longer can be gathered. Members of the public who have used the island’s pathways are invited to submit evidence by email to: V.Penny@dorsetcc.gov.uk
