People are being very hard on Sixtimes. He's being threatened with the loss of his home, no wonder he's distressed. Sure he's breaking the rules, but guys like him don't check the small-print, and it sounds like a blind eye has been turned to this in the past, maybe for several years. There's lots of others in his position. Cut him some slack - some compromise ought to be possible.
 
Andrew, the simple fact is that hundreds of people quietly live aboard their boats in breach of the strict letter of the law ( it might even be thousands) without it ending up in court

CART only go to the lengths of applying for a section 8 order in the most obvious and uncooperative cases of abuse.

Sixtimes won't lose his " home" if he resumes ( or more likely begins) genuinely continuously cruising or sorts out a legitimate mooring

Dropping the pretence of being a continuous cruiser is the realistic answer ...

Get a permanent " home" mooring ( non-residential), sort out a nominal address ashore, don't abuse the short term restricted time moorings or the facilities and keep off the enforcement team's radar.

Plenty of people have a marina mooring which they only use for a few months in the winter permitting the marina to re-let it (ahem) for the summer when they are off cruising

of course, since they are not claiming to be continuously cruising the 14 day restriction etc does not apply and excepting the short stay moorings at popular spots they can spend as long as they like wherever they like within reason.

if you're cautious, subtle and keep your head down it can be done. Deals can be done, nudge nudge, wink wink, with marinas and if nobody complains nobody is any the wiser

however, it necessitates paying for a mooring albeit at a discounted rate and it is not a lifestyle which is particularly compatible with a need to be in a specific location due to schooling, work or medical commitments
 
It is getting benefits that tie people like this down, in my experience.

And being on benefits is an excuse for breaking the rules?

The reason I pushed our friend Sixtimes so hard for an answer to how long he;s been living aboard and where he has cruised is because *if* he had been living aboard for several years and *if* he had cruised extensively around the system *before* he fell on hard times and/or unfortunate circumstances I'd have some sympathy*

If, on the other hand, he has chosen to move aboard a boat with no intention of complying with the licence terms and conditions but simply to avoid the basic costs of living the rest of us have to put up with (and I've been through hard times financially and had to cope) I have no sympathy whatsoever

* Edit: And, in my considerable experience, so would the authorities (BW / CART) although ultimately they are faced with little choice but enforcement or turning a blind eye. BW turned a blind eye far too often with the predictable result of making the problem much worse. CART are now faced with dealing with that situation

TBH I've got little sympathy with someone who comes on to a forum to promote his cause and is then clearly evasive about answering straight forward relevant questions. We've seen the sob stories and the emotive pleas but nothing of real substance. It makes me wonder how devious he has been with CART.

This hasn't suddenly happened. CART has been trying to get these cases sorted out for many months and lots of slack has been given to these people. If they do nothing to sort things out, eventually they have to face the consequences.
 
Think i read on here somewhere that somebody works for the inland waterway association.well from wot i read on the internet .there up carts ass enyway.so no wonder im getting this kind treatment from him .they threaten me to take my boat.i want them in court and im waiting as im sick ov being threatend.

The Inland Waterways Association is a long standing indepenent organisation. I dont believe it has employees so no one " works for them "

Your attitude and language shows that you have little idea of how the CRT waterways are managed-and why they need to be managed.

They need to be managed and licence conditions enforced to stop boaters who break the conditions they signed up for as Continuous Cruisers filling up short term moorings when living permanently on their boats, so denying these mooring to genuine cruisers.

Is'nt this where you came in?

He-and I- have asked you relevant questions which you will not answer.

This leads us to believe that you are in breach of the licence terms. Because of this CRT have revoked your licence and due to enforcement action you are going to get the chance to have your say in court.

That is good.

If, as you keep suggesting, CRT are or have been unreasonable, the Court will see this and you will be OK.

If, however, you have been breaking the rules, CRT has spent months trying to get you to comply, but you have not complied, justice will be done.

Your thoughts may well be that you are hard done by.

Others may have a different view-I certainly do.

British waterways think they own everything.they take enybody too court not just boaters.they lost loads ov court cases .theres loads ov ppl they drive off the waterways.no body takes them on cus they got money and poor ppl havent .my mates boat sunk one day .it wasnt down long a enforsement officer put a stickr on is boat and said move it.where the compastion for that eh

I'll continue to give this the benefit of the doubt although the period of silence and then the provocative attempt to kick start the thread coupled with the introduction of a new diversionary attack is highly suggestive of a troll, or at best trollish behavior

The Inland Waterways Association does have a small team of employees carrying out admin, marketing and sales functions

I'm not one of them nor am I any longer connected with IWA in any capacity. I am a former trustee ( which is an entirely voluntary role for which no financial reward or benefit beyond expenses can be received by law)

of course IWA are broadly supportive of CART! The association spent nigh on 60 years campaigning for the creation of an independent non-governmental organisation to manage the inland waterways.

IWA is not specifically a boaters organization and rarely gets involved in individual issues, that is not it's remit. British Waterways continued failure to adequately enforce the bylaws and license terms and conditions was a major issue more than a decade ago in my day so of course IWA is going to be supportive of CARTs initiative to tackle the problem

there are organisations whose primary focus is boaters and the key one in this matter is the Residential Boat Owners Association(RBOA)

however, you will find that RBOA does not support the 38degrees petition either!

Sixtime, if you are genuine then convince me that you have a case and I will put you in touch with people who may be able to help you

If you're not a troll and you won't put up the proof that you're being hard done by then give it a rest. in other words put up or shut up

if you're a troll go and play somewhere else. it's tedious, boring and totally devoid of amusement

what on earth are you on about? and what on earth has it got to do with your "case"?

come on, let's have some truth. if you can honestly answer the following questions with a simple " yes" you may have a genuine grievance. if not, you haven't got a leg to stand on

1. Does your boat have a current Boat Safety Certificate?

2. Does your boat have a licence ( Continuous Cruiser or Residential)?

3. In the last twelve months have you spent a significant period of time more than 25 miles from Nottingham?

if the answer to any one of the above questions is " no" you are in breach of the license terms. end of

25 miles was just an arbitrary number. 25, 50 whatever. The point is whether or not you are a genuine continuous cruiser moving around the system at large or, as is becoming increasingly obvious, a " towpath lurker"

you're story is slipping by the way as is your use of txkspk
