I read with interest the article about Boating to Belgium with Red Diesel and concur with all of the comments made in the article. However, having read recently that the Belgian Embassy in London is putting out a completely different message.
Would be useful if the RYA could check with the Embassy to ensure that they concur with the “Ostend” View
I, for one, cannot afford to the risk of paying a fine in the order of 750 euro for having red diesel in my main fuel tank while carrying out legitimate (and legal as far as I am concerned) leisure activity visits to another EU Country.

Gus Lewis, Head of RYA Legal and Government Affairs responds
We have been in contact with the Belgian Embassy in London which has confirmed the Belgian position in this matter has not changed. The use of red diesel in Belgian waters is non-compliant with EU legislation and will continue to be handled accordingly.
However, whilst the risk of being fined does remain as we said in the article the RYA is not aware of any UK boaters being fined by the Belgium authorities for the presence of red diesel in their fuel tanks during the 2012 cruising season.
Please keep letting us know if you experience any difficulties abroad using ‘marked’ red diesel in your fuel tanks whilst abroad. Email us at legal@rya.org.uk
