Help with finding a used boat VAT post and thread.

As above have searched and cannot find .
Offered ex Charter boat in Spain and can be invoiced with official VAT invoice as being sold by company.
Boat will be kept in EU.
Advice appreciated.
 
Keep it vat unpaid and take it out of the eu every 18 months.
This is one advantage of Brexit!

You can do that if you are no longer a resident of an EU country. The rest of us have to pay the VAT.

No sure how to actually manage such a sale - you might have to make the transaction outside the EU. Be careful with Gibraltar - it might not actually count as being outside the EU now it is in the Schengen area.

Does anyone know the facts about Gibraltar.
Two questions.
Does staying in Gibraltar affect the personal 90/180 day rule?
And can sailing to Gibraltar reset the 18 month TA rule for UK (non VAT paid) boats in the EU?

I don't know for sure. But I think the answer is yes to both.

I wasn't specific about my first question.
Does staying in Gib get included into a person's 90 day limit?
Just like visiting any other Schengen country.

I have a friend who is considering a cruise down to Gib and staying there after his 90 day in 180 is up.
I think he will be outstaying his limit but I didn't want to tell him as I'm not sure about Gib.

Don't risk overstaying. The consequences can be very severe. Like being excluded from teh Schengen area for several years.

It really is muddled. I attach a quote from Euro News

Gibraltar will not become a Schengen member, he (Picardo) said, but will become a Spanish entry point to the wider Schengen zone.

"Spain is a member of Schengen and she is extending the opportunity to enter into the Schengen area if you enter one of the entry points in Gibraltar, and Gibraltar has two entry points: ports and marinas, and the airport," Picardo said.
