Dodgy Guardiennage

My outdrives were destroyed while under a guardiennage agreement. This happened while we were not on board but the boat was supposed to be washed and taken care of. But, in our absence, we returned to find that the drives were corroded due to negligence on the guardiennage agent. We have dealt directly with the guardiennage agent and sent letters to the corporation he trades on behalf of. The corporation have been very unhelpful and we have got nowhere due to this agent's guardiennage.
Our insurance company has denied our claim even though it is fully comprehensive. They said that they will assist us in arbitration. Has anybody any experience with Gerencia de la Subcentral in Madrid?
We are presently insured with Mapfre. Can anyone offer advice or assistance in this situation please as we have had to pay out a large amount of money for new drives.

Explain a bit more. Exactly what were the gardiennage chaps meant to do to your drives? Something important, if their failure to do it caused total destruction of the drives, I guess?
 
I've got no direct exp of this but always thought the principle of guardienage was just to look after the security of the boat and make sure it's kept nice and clean. Sort of superficial wash and brush up stuff. Are you saying that they're supposed to provide full maintenance service too? To what level? As jfm says bit more info needed.

if the boat was left in the water ,it's down to you, if they dropped it on the quay who knows! by the way boats=£000000000000

Was the boat in or out of the water.
Exactly what happened to outdrive/s to cause them to need to be replaced.

Sorry it took so long to reply. The boat was in the water and connected to the shorepower with all appliances on. I asked the company why and he said that he didn't know why. The water pressure pump was sucking air so kept switching on and off for five months. If they had checked my boat every three/four weeks they should have noticed all the power switched on, wouldn't you think?

Wots this got to do with outdrives? You cant expect others to do everything for you. Dont know why your outdrives have rusted away, but dont see how you can blame some one else. Are you sure its rust and not just lacking anode protection. When was the last time you had it out and serviced.

New anodes fitted in oct 01 & also 2 new props. They said it was normal for the props to corrode. The co. offered 6 months of guardiennage money back & said its not their fault witnesses said the co. hardly looked at our boat. Solicitors advised us to sue.

There are all sorts of arrnagements but certainly many will offer a contract of what exactly they plan to do. This can extend to several pages of "every 2 weeks wash boat" and "check fenders" and "check boat systems". indeed, quite a lot of it is confined to keeping an eye on things and THEN ringing to offer service at an extra charge - but it depends what is in that contract. If no contract then no case, imho. If there is a contract, then need legal bods, of course. I wd take care to ensure that there is an actual compnay worth money to sue.
