AIUI, there is nothing wrong in that action, absent any specific local rule to the contrary (which there isn't in these waters). I realise you were not actually saying a rule was being broken. The marks mark the channel but each skipper is free to deviate from the channel if he wishes and I've gone "wrong" side of marks many times in Solent area. Likewise, there is no rule being broken if you pass to south of a north cardinal, say. It might be foolhardy and even tortious, depending on the facts, but there is no rule being broken. AIUI, E&OE, etc

That's not a starboard mark (or any other sort of nav mark) - it's some sort of instrumentation/science buoy.
