Coppercoat conundrum (not used yet, unused kit)

While i had my cracked hull repaired last year after getting the hull sandblasted another yard member said he had untouched coppercoat for his 30ft Limbo. He said i could take it and pay whenever, no rush. I had seen other boats in the yard had it with good results so took it for later. Then after a few months with the unopened boxes in the loft, i heard it had a limited shelf life, the kit was 2017. I had someone who did my boats barrier coat take away one of the coppercoatboxes and they eventually had a contact at Coppercoat test the epoxy, and i found out this week it isnt curing properly due to being out of date and have been told the kit without the eopoxy is worth £100 at best. Now the guy i got the kit off is now saying i should pay the £500 he wanted despite me not saying id defintely use it in the first place, and now i have been told by others id likely need to buy new epoxy for the copper powder to cover my 27ft waterline area at a cost of £300. Unsure what to do. Very stressed about it all now.

How I hate "vague deals"!
Did you buy the goods and agree a price to be paid? If so I think you owe him the money unless the goods were faulty at that time.
But why didnt you pay for the goods at the time? That suggests there was some sort of sale or return arrangement?

If you took it away I would say the deal was done at that time. Was it out of date at that time? If not then I would say you owe. If not then would it be considered reasonable for the seller to say? It could be he sold it in good faith not knowing and you also bought I good faith not knowing. Is it a case of caveat emptor? I would say it probably is. I would argue to pay half as a 50/50 settlement and leave that on the table. If he refuses leave it for him to make the next move.

Call CopperCoat and get the facts about shelf life.
 
If someone has just applied coppercoat & it is not curing it is probably too cold anyway. Storage is also an issue & keeping it in a garage to be subject to incorrect storage temperature will have done it no good.
What you might be able to do is apply the epoxy on its own, as a barrier coat when the temp rises. Then get new epoxy & apply the copper powder & new epoxy over the top.
Did the chap give you all the accessories. ie rollers, pots & thinners. That adds to the cost & is needed. AMC will supply as part of the package

Ring CopperCoat, they are really friendly people, and ask them.

Disclosure: they gave me a tee shirt at the 2019 Southampton Boat Show after I said how pleased I was with their product.

it was just the epoxy from the kit tested, a small patch and it didnt cure properly. I already have new epoxy barrier coat applied to my hull by a guy from West systems last year
 
As I am sure you will be aware, AMC state that the shelf life of Coppercoat is 1y in unopened containers at 20C and shorter if it has been stored at temperatures above this.

Therefore if the materials were originally purchased in 2017 they would have been considerably beyond their shelf life when you entered into the agreement with the original purchaser.

Quite how you unravel this is difficult as we don't know the full details, but it is not unreasonable to assume that the materials, at potentially 2y past their shelf life, were sub-standard when you took possession of them.
 
If he gave it to you out of date and it wouldn't have cured a year ago then either give him the whole lot back or the £100 its worth. He's an @rse if he kicks off.

I bought a copper coat touch up kit a year ago, which I used some of and now I know this goes off will get rid of the small amount I have in the garage.
