About 18 months ago there was a near collision between two ships just outside Portsmouth. (For details, see http://www.maib.dft.gov.uk/reports/pdf/pride-of-cherbourg.pdf) It was one of those occasions where one ship interpreted it as a crossing situation and the other as a head-on situation, complicated by the stand-on vessel thinking that local rules applied.

As a result of this case (amongst others) IMO today changed Rule 8(a) of Colregs. As from 29/11/03 it will read:

8(a) "Any action to avoid collision shall be taken in accordance with the
rules of this part and, if the circumstances of the case admit, be positive,
made in ample time and with due regard to the observance of good seamanship."

The "...be taken in accordance with the rules of this part...." is new. It will be interesting to see what, if any, effect it has on small craft.
