CE / RCD exemption

As I saw, it boats built/ sold and in use prior to 16th June 1998 were exempt from needing a CE mark etc.
I have since read that this exemption applies if the boat from new was NOT sold outside the EU.
Does this mean the if a yacht built say in 1997 was sold in the UK it would be exempt but if sold in Croatia or Turkey it would NOT be exempt and if that is the case would it need a certificate now to sail in EU countries?

I would suggest you contact the RCD dept at the RYA as I have seen conflicting advice on the forums regarding this!

It doesn't matter what it's done or where it's been. It' abundantly clear that if it was built in the EEA (RCD is not an EU measure] before that date, it's exempt. If it was in use in the EEA before that date, it's exempt. If it was both, it's also exempt.

To quote from the RYA guide on RCD:
A boat does not need to comply with the RCD if:-
It is one of the exclusions listed in Appendix 2
It was built in the EEA prior to 16 June 1998
It was in use in the EEA prior to 16 June 1998
It is only visiting the EEA for reasons of tourism or in transit (time scales are undefined)

These are self-evidently 'ors', not 'ands'.

P.S. Before someone asks me to justify that last claim, let's assume for a moment that the sense is 'and'. In that case a vessel would have to be an appendix 2 exclusion (historic craft and other oddballs) AND have been built in the EEA before '98 AND have been in use in the EEA before '98 AND be only visiting the EEA. The number of craft satisfying those conditions in any one year might be what...two, three, none? Amongst other things it would mean that a vessel which had been built and spent its entire life in the EEA could not be exempt (because it could not be visiting).

The boat was built in the EEA I by Beneteau) prior to 16/june 1998.
It was in use in and out of the EEA before that date although based in Croatia.
It will be taken to Greece etc where it will be used for reasons of tourism and in transit ( whatever that means)

So I guess it is exempt?
