Buying VAT not paid 12m yacht in Greece for NEPA and get VAT exemption

I am planning to buy "VAT not paid" Bavaria 41 in Croatia, import to Greece, and setup NEPA.
Both countries are in EU. In Greece yacht purchases (above 12m) are VAT exempt.

The yacht has the Builder certificate and it lists 12.35 LOA (length overall) , but the yacht documents lists length=11.99m.

Does anyone know whether this yacht will be VAT exempt?
 
All limited companies may be converted into NEPAs but not vice versa. Of course all Greek companies may be owned by other EU companies or individuals (or non EU up to 49%) who must obtain a Greek Tax Registration number and also appoint a Greek person as legal representative in Greece against tax, port and/or other competent authorities. Plus proof of 300 days charter in the first 5 years if boat is under 20 metres.

This new rule was brought in last year. Originally it was for all yachts (regardless of size and regardless of the VAT status of the buying entity). It was then changed to only apply to yachts less than 12m.

So, in your instance, the Bav 41 is under 12m, and the selling Greek business will have to charge your new Greek business the VAT, and you won't be able to reclaim it.

The waterline length is the length they seem to look at (ie the 11.99m)

It is going to make it very difficult to put a yacht under 12m into charter in Greece from now on.
 
I can't remember where, but I think it is the Builders Certificate or the CE certificate that lists it as 11.9m. That is the one they look at.

What year is it as I would be very surprised if it was under 12m
Are you connected to the OP as you have seen the builders certificate, as the OP says the builders certificate says it at 12.35m?
