Morning all , This is my First post As I have Just done a deal To Buy a boat in Jersey ( Vat has not been paid ), This is my first boat but I am buying it with a mate 50/50 who has owned smaller boats for 15 years.
Can anyone help us with the following

Thanks

1) good surveyor in Jersey
2)would you have the Volvo Penta agent who has been servicing the engines from new (KAD44's 240 hrs) carry out a engine survey/test or get a independant company to do this. the boat has full dealer history from new
3)how long do we have before paying the vat when It comes back to the UK

Thanks in advance

1/ No point in having a survey now.

2/ Hmm. Should you not have done this before you bought it??

3/ Vat problem will arise when you come to sell.

Theoretically, VAT is payable the instant you arrive in any EC port including the UK but the likelihood is that, unless you are very unlucky, you could enter the UK and nobody would bother to check

I hope you have just made an offer rather than bought??

If so do not yet the volvo agent to survey. Is he going to find the errors in his maintenance work, I don't think so. find somebody not linked to the boat.

All boats ahave falts and a good surveyor will find them and save you the cost of his fee and stop you buying a heap of rubbish.

I would call Buzz White from Guernsey to survey it. Peter Furby used him and was well impressed. If you need the number I will get it for you.
Call FREEPORT in Jersey to arrange an independent engine surveyor or ask Buzz I would not use Bob Le Galichon from Le Gallichon marine.

We Have agreed a price for the boat but the offer is subject to a satisfactory survey/Engine test.

We are going over tomorrow to pay the deposit and arrange for the survey/Engine test ete.

I have another quick Question. 'when you pay your deposit is it held in a type of Client account ' so if there is any problem with the survey/Broker and you can't sort it out you would be able to get your deposit back...

Thanks

You can give them a post-dated cheque for the deposit; dated for the day after the date of survey. They wouldn't be able to argue with that.

Hi

If you are driving the boat across to uk and basically pulling it up into a marina wont have any vat problems until you sell it.

If you are having it transported across and thus passing any customs points then they will not let the boat through until the vat is paid.

I'd be careful about deposits if I were you. Jersey law is not the same as UK law. I don't know how legally binding a deposit might be, and whether it is regarded as refundable or not in the event of you rejecting the boat following an unfavourable survey. Check thoroughly before you hand over any dosh.

Bill.

Legally, thats not correct. VAT is due the instant the boat gets into the UK whether by sea or road but I agree its unlikely that you will be asked to prove VAT status in any UK marina

The best surveyor in Jersey is Peter Williams. Call him on 01534 857281.

DK Collins are the local Volvo agents, or you could use Fox Marine Engineers on 01534 721312.

When you take the boat back to the UK you will have to clear Customs because you will be coming from outside the EU. Also your boat may well have "Jersey" on the transom, so it will be obvious. You will have to pay VAT on an agreed value (Bill of Sale/Invoice) at that time (but you will probably get time to pay). Don't try and avoid it whatever you do - they could confiscate your boat.

Best of luck.

Deleted User is correct. VAT is payable the instant it comes into UK. OK, you may not actually get caught but to bring it into the UK without paying VAT is plainly against the law and if/when you are caught you will have to pay the VAT plus interest plus a considerable penalty plus possible prosecution. It aint worth it imho

The above assumes you own it personally and that you live in UK

For the engine survey, I would use whoever you will use for regular servicing when it's back in the UK, then no surprises on first service.
