I think selling from the boat has more to do with ensuring all catches are properly registered for quota purposes. But of course why should the fisherman be able to circumvent the health rules?

Generally it is the level of processing and the market you sell to that dictates the health regime. Selling whole fish straight from the boat is very low risk, as is fish in general: if its bad enough to make you ill you won't get near enough to eat it. If you start filleting then a fairly common-sense regime is sufficient, but in this case the idea is to take it as it comes. I have a shop which is fine for retailing, but I'm not allowed to sell to restaurants, I would need refrigerated premises and a much more strict health regime. This direct selling is great for everyone provided you can put up with occasional breaks in supply and variance in species available.
As far as the law and the MMO is concerned, I can sell up to 25kg per customer straight off the boat, as many times a day as I like. If I want to buy fish to sell, I must register as a 'buyer of first sale fish'.

Hop across to Boulogne - fishing boats come in during night - catch hauled up onto quay - you buy it the next morning - fresh. Simples.
 
It is nice if you can get to buy direct from the boats...

nit inly does the fish taste better... but it helps thaw the ice between commercial fisherman and pleasure boaters....

tried twice with two potter boats we sailed close to last week and both gave a pretty surly ''no'' in reply. Dont understand. There are no sea based patrols by hmrc and i've never seen one by defra

Perfectly legal for him to sell you fish over the side in lots of less than 25kg per punter.

How does the fish become more healthy by being driven around the UK and sat on a slab in a window for a day or more? I buy fresh fish from Mudeford (http://mudefordfishstall.co.uk/) sometimes and I always get asked if I want it cleaned and prepped so it's presumably not that.
