buying a boat and part 1 registry

Martin, You talk about Bills of Sale (plural) going back 5 years. The Part 1 Registery lasts for 5 years so it seems the present owner has not transfered it into his name. The Part 1 that expired 7 months ago might well have been an already defunct registration from an earlier owner. If so this will add to your difficulties in getting Part 1 in your name. If I'm right, I'd be insisting; "no Part 1 - no sale.
 
The boat is registered to the vendor but run out in may. hence it is clased as a unregistered vessel. so for me to register it, the MCA require proof of five years bills of sale.
i have done a search on the vessel and every thing seems above board there, ownership correct.
 
OK - just seems weird that if you have more than one BoS covering the last 5 years and Part 1 lasts for 5 years before it has to be renewed, how can it have expired 7 months ago?
 
there is only one bill of sale covering that period, and that is from when the vendor bought the boat, the bill of sale i have seen is a photo copy of a MCA form. he has owned the boat for just over 5 years, the part 1 lasts 5 years, he never renewed it hence it run out in may.
 
You should definitely get the original on completion, but definitely not before then.

The re-registration of the Vendor as owner under Part 1 should be his problem not yours. Then you need to register the transfer of ownership, that's for you to do - but only after the sale.
 
That's very helpful and confidence building. It makes renewing easier for you - even easier for him. Checking back on my boat's history the guy I bought from had exactly your situation when he purchased. He insisted, and got, the previous owner to get Part 1 as a condition of (a private) sale.
 
OK... looks a bit better. Current owner has owned for 5 years and 7 months, (approx.), and you can see Bill of Sale, (singular), for his purchase, and Part 1 registration certificate covering his period of ownership.

presumably your search of ownership was with the MCA, and the search confirms the above.

I would still be asking the current owner to be reregistering the boat Part 1 and, if he resists, you could offer to pay his costs on completion. If you didnt buy the boat, he has an easier sale with an up to date Part 1 registration.

If he wont reregister, I would walk away. You will probably find a nice part 1 registered boat well before you want to go sailing, (April/May???)
