Do you trust the government (any government) or the courts to use powers only for their originally intended purpose (whatever the original purpose was in this case)? I don't.

Can't find it in myself to get too worked up over the issue. Probably because I don't drive my boat under the influence.

I'd be far more concerned with the other ways they could take your licence away under that law.

By 'eck I'm on doo doo then, I was pretty illuminated Saturday, from lunchtime until early Sunday morning, and then as long as it took for the hangover to lift, roughly 10 am today.

During this time, in the earlier part of it, I had the boat keys in my jacket pocket. On Sunday I watched as my wife helmed the boat:-)
 
I agree.

I don't particularly want to see drink limits imposed mainly because, despite the recent call for it by MCA, the figures just don't stack up for the need for legislation.

Having said that I think it's foolish to be drunk on a boat, even in a marina. If I'm using the tender I don't drink much because I'm invariably responsible for others and the fact that they are in my tender means that I care enough about them to not take an unnecessary risk. I've seen too many "near misses" in tenders to take the risks lightly. At least in a marina or a tender they are unlikely to harm me. But I wouldn't want to see legislation introduced.
 
OI seem to remember that there are already various laws governing our conduct and alcohol relations .... Harbour Regs, Safety at Sea, Endangering Life etc.

I seem to remember in my distant mis-spent years previous that when I was Banned D&D - the law doesn't actually always refer only to Motor Vehicle ... and is how drunk in charge of Horse / Bicycle / even walking the street can be done. I have a strange feeling that careful reading of the rules may actually mean you can get copped on a boat .... Drunk in charge of a vehicle ....

Headings are for convenience only and do not affect interpretation. Even if they did, the heading Powers to deprive offender of property used etc. for purposes of crime relates to sections 143-145 only. Section 146 has its own heading: Driving disqualifications
 
Hmmm. Thinks..... 2 + 2 = .....

1. There's already been a public consultation and government has expressed an intention to introduce legislation on drinking/boating.

2. MAIB is pressing for legislation.

3. It's pretty obvious that a licensing scheme is needed in order for drinking/boating law to have effect, but that would be expensive and time-consuming.

4. Statutory power to disqualify people from holding road driving licence for non-motoring offences already exists.

5. Road driving already has sophisticated licensing system.

6. Vast majority of boat owners will also be car drivers.

7. All that's needed is legislation to make drinking/boating a specific offence, possibly with tie-in to s.146.

2 + 2 = 4.

With all the reams of legislation which has been passed for both the Marine and Road worlds over the last umpteen years there has never been anything done to bring the two separate fields together. They won't try now. You can sleep easily on this one; it won't happen.

Oh, but Tommy you do realise that this is discussed in Sweden as well, actually. Not too long ago someone was proposing it, I guess it was this traffic minister woman who is into licensing boats as well. While you probably will go away without the latter, being a British subject, the first part will hit you hard (and me too).
Still the issue is not yet decided and of course the Coastguard people probably take their tots themselves so we'll see about that... And we have an election this fall so maybe she won't be in charge after september any more...

But the Legislative and Regulatory Reform Bill going through parliament allows ministers to alter any Act of parliament without the need for it to go back to the Commons or the other place.

The cannot invent new Acts, but they can 'reform' existing ones.
 
Good grief, what are you lot going to do about it? It is dreadful. I say 'you' since I am disenfranchised; while I pay UK taxes and am resident for tax purposes, I do not have a 'home' and therefore have no vote.

I stayed in Baltics - good lifestyle, no EU, PC is an abbreviation for Personal Computer only - we don't have PC society here ... a spade is a spade ...., no bulls**t to worry about and things were tickety-boo ....

Then some stupid b*****d decided that they wanted to join EU ....

As I see it - this Drink /Boating debate is typical of the crock of rubbish that is invading the UK and EU ... along with other "developed countries" ..... seems that development of a nation also incurs governmental stupidity ?? Maybe it's because they don't have enough fundamental proper things to think about ? Like education - healthcare - armed forces - police and law ......

Maybe I'm a natural cynic ?????

Australia has similar problems to here, if not more in some areas, but it is booming, unfettered by the EU. As a retiree, I will accept their foibles, knowing that they will soon not bother me. Yes, I know they have drink/boating laws, but they were introduced before I will get there and as a guest there I would fall in with their wishes. They also have very tough road drink driving laws and I have rarely been to Sydney without being invited into the Booze Bus.

In the meantime, the IOM has a tax rate of 10% with a maximum of 18%, no capital gains tax and the rates on a three bedroom house is around £250. Crime is relatively low and it is ouitside the EU.
 
Australia is a police state, we may look upon Austrailia with rosy glasses but it has much more in common with USA than us. There are any number of unrelated offences in Australia whewre yo will lose your driving licence, it seems they use it as a punishment, they take the view that it is a great leveler, a fine only hurts those who can't aford to pay it. The set speed traps over great distances measuringthe average speed between two points. Cyclists are fined hundreds of dollars for speeding inspite of the fact that most bikes do ot have speedos. Ride a bike without a helmet (what harm does that do to anyone else?) and you will get a large fine.
