agree on these points, and would need more info and possibly terms of contracts if any. However, it's worth following up, though I'd be looking at a gentlemans agreement rather than a legal battle, as it's probably not worth the court costs

It's a huge area, and one in which I'm probably not best placed to advice. I understand it's implications in IT far better than in construction plant. What you will see from the examples I gave, is that courts tend to give short thrift to badly worded exclusions, and that the legal advice usually is to give careful consideration to what it is you want to exclude, and make sure you specifically word that exclusion, rather than trying for a general cover all exclusion

The issue here is that I have incurred additional costs by way of lift and block, labour and the cost of the replacement bearings... there doesn't seem to be any related damage to gearbox or other parts .. at least that is immediately evident.

I've sought legal counsel.... just in case we don't see eye to eye on this.

From what I've been advised, as the engineer ordered the parts and was acting in a professional capacity, he had a duty of care to ensure, that not only the correct parts were ordered and fitted, but furthermore to ensure that neither my nor the vessels saftey would be compromised by such work. In fitting the incorrect sized bearings on one shaft he was negligent and will be liable for all costs.

Lets hope it doesn't need legal intervention.
