Boat buying in Holland & paperwork

In February I bought a Cornish Crabber in Holland; this was after signing the sales agreement, paying the deposit, having a survey, and then paying the remainder on receiving the invoice. This was all through a broker, but the owner's signature was on the sales agreement.

What I've never received is a "Bill of Sale". Having chased about this several times, I'm told I have the paperwork I need, but I'm concerned about perhaps having to produce a BoS if I ever sell in the future. I was about to write direct to the former owner, but see the only paperwork with an address on is itself an invoice from some years ago (so perhaps this is how they do it) and unfortunately the address is hand written and difficult to decipher.

Should I be worried?
 
Yes. The Bill Of Sale is the legal transfer of title to you. Insist the broker arranges it. If he is a member of HISWA take it up with them. Check also that the boat is not still on the Dutch register.

A Bill of Sale is a must under HISWA rules. Also, you must get proof of VAT paid. This is on the original purchase invoice, or can possibly be obtained from the builder - if he is still in business.
 
I asked the HISWA surveyor to resolve this for me, he approached the broker and replied;

You should have (& I do have)

the old purchase contract of the owner with the previous owner;

· the new purchase contract with you, the owner and the broker on it;

· The invoice from the broker of the ship;

· the VAT document of the ship.

These documents are common when a ship will be sold.

I have nevertheless asked him to approach the previous owner and see if he will provide me with a simple Bill of Sale, explaining to the previous owner the difficulty I may have in selling the boat in the future, but it does seem the previous owner, the broker and the surveyor all think the above four documents are the only ones needed in buying a boat in Holland.

Ask him to complete the MCA Bill of Sale Document, download from MCA website, very simple to execute.
 
Just in case anybody ends up with anxiety I have had, the surveyor has confirmed the four documents I have received are what is required in Holland, but they recognise we need a Bill of Sale so have something very similar to the RYA BoS which should be provided when selling to an English customer, and mine now should be on it's way.
