There are official B of Sales ... well and good and of course the Home written jobs ...
As long as the Bill of Sale is signed by both parties and is also comprehensive with its listing of what is sold etc. - then I go for Home one ... have done it for all my boats and haved not had any trouble with Registry / Insurance etc.
It is a matter of care and wording to ensure that it is acceptable. I have looked at various vai Official sites MCA, as well as RYA etc. and to be honest if I was selling / buying a very large job or ship - OK .... but for the sub 15K job ... what I term the bread and butter yacht market ... they seem a bit of an overkill. IMHO of course .....
Nigel i dont doubt yours are perfectly done but often home made docs for bills of sale are a bit messy. Problem is people tend to write home made ones as if they were a contract of sale. Stuff like "this boat is sold for £XXX and the seller warrants only this and that and the buyer is reponsible for such and such". The MCA bill of sale is not a contract, it is a title document, which is similar to a sale contract but er actually a bit different. I think much better therefore if folks use the MCA one, as per the link given above, rahter than end up confusing the contract and the title.
I repeat, I'm commenting in general only, not criticising your Home docs. I agree with you it is not necessary to use the official MCA doc, and a correctly done Home title doc is perfectly good
There can be big problems using the MCA Bill of Sale on an unregistered vessel or Small ships registered vessel in that the vessel is not adequately identified - in effect it would only identified by its name. MCA BoS is fine for full part one registered vessels in that the vessel is fully identified by the Official Number on the registration certificate - only issued after check by certified measurer - even an engine change has to be certified.
For a Small Ships registered craft or unregistered craft the RYA BoS is far superior as the craft is much better identified by Type (Make and Model) year built, Length, Beam, Aux power SSR no, and Hull Identification Number. PM me and I'll send you what I use.
