A Tarquin Denial Traderism - Ocean Deep Saga Story

Sorry, but maybe it was not clear in my post. I meant it was a Signature at the boatshow. The others I have looked at belonged to other owners and when I was considering buying one in the lates 80's. I have nothing against Traders, but when you look at a Grand Banks and Fleming, as I did, you see the difference in quality and finish.
Have you ever compared closely the 3 makes, if you do, you will see what I mean?

Paul and I went from Trader HQ to the London boat show on Ocean Deep we followed another Trader I believe it was a 575, onboard was a professional skipper delivering here to Libs, with some time to kill we tied up both boats and the crews opted to have a spot of breakfast on land in a near by café, we tied both vessels up outside the London airport bridge, and were joined by other skippers from Sunseeker and so on, the delivery skipper on the other Trader told me over grub that ‘’he was once caught in the wildest sea state he has ever encountered in his career and thought his time was up, he said he turned the 41 into the storm and rode it out for 11 hours all on board were ill and amazed on how this boat performed , but he did state that the slab back Traders did not like following seas, but are manageable in experienced hands and require sufficient power on tap, he could not emphasize enough how great full he was to be on that boat in that storm.

Not only have I not had an apology but I have had an indication today of the tactics being employed to mess me about.

I sent an email and letter to Tony Chappell on the 1st April 2007 asking for a full refund plus costs - he has openly replied to say that he has employed a lawyer to handle the matter and now it seems nobody understands what the basis of my offer was!!!

I quote from my email/letter of the 1st April 2007 –

I thought that meant what it said – but it apparently means something else to Mr. Chappell.

To make it clear to Mr. Chappell - it means pay me the total price of the boat circa £940k and my costs which need to be defined and agreed but which the liability for which has already largely been accepted.

It does not mean taking back Drumbeat at an inflated price that would cause me a loss of circa £100k to £150k after it has stood at Emsworth for 18 months as ridiculous high prices have been asked for it and so has not sold. A boat that I have had no use out of just like Ocean Deep.

I am willing to discuss any basis of settlement across a table. Mr Chappell is not.

IMHO I am started to be messed around as always. Tony Chappell in an open letter has declined a meeting with myself and the mortgage company to sort out the principles of an agreement. I am not publishing details from any ‘Without Prejudice” letters, only open letters. I get an open email from Tony Chappell saying one thing i.e. that I can discuss the basis of the deal with his lawyer and an open letter from his lawyer this evening stating that the basis is given and that he needs only the details.

I hope I am wrong and that it is a misunderstanding but after 16 months of no apology – after Mr. Chappell refusing to respond and answer simple questions in public – after it took until 22nd December to get all the survey points from survey 1 accepted, I do not think I can be blamed for being a bit sceptical about Mr. Chappell.

What is required is a straightforward discussion to form the basis of an agreement - the principles. The basis of my offer is clear but TC does not see it that way so the sensible thing to do is discuss the difference. To see if we can reach agreement and the best way to do that is face to face – lawyers present if he wishes but face to face. An agreement could be achieved in a few hours. The detail could then be fleshed out in a few days. Yet without a proper discussion of those principles - the basis of the agreement, there is no point in proceeding.

I am now going legal as fast as I can but I am also going to increase publicity - a lot. I am more than happy to stop the publicity if serious discussions were going on but they are not.

The path will be sorted out this week and I hope Mr. Chappell understands that I tried to avoid it but it seems he is happy to have the sordid 16 month nightmare published in full as I ratchet up the publicity both on the Internet and off the Internet. He seems to want this rather than sit down and agree the basis of an agreement that does not leave either side to make wrong assumptions – and hence provide a clear basis to proceed to fill out the detail on.

The full history IMHO is shocking. I believe any fair minded person reading the facts will be horrified. I believe that any experienced boater reading his published statement to ITV will be a bit shocked. I will ask ITV for permission to publish it.

One word I have never once heard Mr. Chappell say is “sorry”. My boats sits out in the dry just 100 foot from his office in this great boating weather a testimony to his total indifference. Would you not think that this would act as a source of guilt? 32 tons of mess standing there in his yard? No - not at all. It is still a total mess, -they are still only part way through even changing the hydraulic oil – a job that has taken over 2 weeks to do a few hours work!.

In the almost 3 months of being at Emsworth being fixed – making some 9 months at Emsworth there is now more work to do than ever in its history and yet they still cannot give me a schedule of work.

Sent a survey that is damming there is no response.

Sent a survey that suspects that there is an off white gel coat instead of the blue gel coat I paid about $42,000 extra for – there is no response!

Why Mr. Chappell cannot face me across the table to discuss the basis of a deal with the mortgage lender present to moderate the meeting is beyond me. The principles of any deal have to be agreed and only he on behalf of Tarquin can do that. He should hide behind nothing to do that.

I would have thought that about 8 lost boat sales caused by buyers reading the publicity would have penetrated but it seems not.

I think the next 24 hours will decide.
