A Tarquin Denial Traderism - Ocean Deep Saga Story

When down on Ocean Deep a week last Wednesday, I took these photographs of the saloon. Please note the heavy floor panels have been moved down the forward steps and lent against doors there.

Here is a better shot of those panels leaning unprotected against the doors - of course small marks were left on the doors. Also notice that above the small table the corner piece is unmarked - no notches out.

Then last weekend we arrive to find that corner piece above the table badly chipped like this:-

They had moved those heavy panels back and put them in the floor.

Fairly clear that they damaged the corner teak above that little table BUT no - Tarquin blamed us stating that we must have done it!!!!

Even with a mess of a boat sitting out there by their offices 16 months after purchase with more work to do now than ever in its history they still blame shift.

We have the images to prove it but in true Traderism terms, evidence means nothing, the facts mean nothing - we must have done it despite that fact that we have moved nothing!!!

Lets hope they take the boat back and such things do not matter but it really annoys me that with the total mess of everything they have the cheek to continue with their Traderisms.

Yes they took my boat without my permission out to sea - they had to swing a fluxgate but after doing that they spent almost an hour doing high speed trials up and down using another boat to shoot from so they could get brochure images. To do this they used my fuel!!!!

I wrote to them and asked that they never use the images and all I got was a promise to give me a copy, which they never did!!!

They went ahead and have used images of Ocean Deep in order to sell other boats when at the time Ocean deep was not even seaworthy. But then it was not seaworthy on the way to LBS but some water in the oil solved that one for them ... the customer is as nothing. IMHO they are arrogance personified.

Tarquin just ride rough shod over you on issues such as that. It's not worth taking legal action as well they know.

Basically once you hand over the money, my experience is, you become as nothing in their eyes.

I am doing these threads to hold the pressure on them whilst they think about responding to my request and before the next escalation of publicity.

From what I understand if you rejected the boat then title returns to trader and you have to sue them to recover your costs. One this process has started and Trader have a potential liability are they still allowed to pay dividends or divert money away from their trading company? Just a thought.

I suspect that this has already been suggested before but Trader have a "Trader Day" in May. How about hiriing a light aircraft with a suitable worded banner to fly over the yard. You'd got probably even get the local rags interested.

I have not rejected the boat because to do so would return ownership to Tarquin and hence I would risk losing the boat and my money.

Tony Chappell is not new to angry customers. Others have tried banners at SIBS right outside his boat and he paints them as extremists and many people swallow this hook, line and sinker.

I am using the truth as a tool to help me get justice - the spreading of that truth has already lost him 6 to 8 boat sales (I keep hearing from those who have stopped proceeding to buy). Yet I have not lost a single sale - their deplorable product and service has done that.

I can escalate this publicity many. many notches upwards. I already have incredible stuff that I am holding back on keeping my powder dry. If the matter has not been settled then before their open day there will be increased publicity.

I believe TC would love it if I resort to planes and banners. I have not ruled it out as it could advertise my new Ocean Deep Saga site that will have been launched by then .... I just hope he sees sense and refunds me.
 
I am deadly serious about getting my money back.

There are things going on behind the scenes to pressure the issue.

I do find it very difficult to control myself at times. The arrogance from tyheir head of their yard when he put water in the oil - the blame culture that exists there - the incredible way they do not solve things and then blame those that do such as Andy Ball from this forum.

I am totally livid but I have to laugh otherwise I would be crying all the time. Basically I will not go away and they will end up without any customers as more and more potential customers hear about my plight and how they treat me.

I now have proof that their repair work to certain things is dangerous and renders the boat unfit for going to sea. That is their repair work let alone the original fault.

If they want to continue to dig themselves into a hole and out of business they can be my guest. Their behaviour is disgusting and more and more people will find out about it.

If I were TC I would have done the honourable thing and bought mne out long ago. Even if only to save my own business. However some people in this world think they are invincible ....... maybe TC is one of those?
 
Hmm yes, I was a bit annoyed to be blamed for that ( not the first time, hey ho) given that I wasn't even on board after Tuesday evening.


still, maybe I was wrong eh? like the thrust bracket & engine alignment, the fact that the port thrust bracket had moved, the electrical interference from the light dimmers, the fuel system causing one tank to overflow, the over-extended engine mount screws etc etc

It is a limited company and on the last set of public accounts does not have the resources to refund.

This does not mean that it cannot refund - it just means that its too risky to return title to them. They could borrow with all sorts of guarantees including personal ones.

I have no idea about the personal wealth of mr. Chappell.
 
I went to trading Standrads last year about the refurbished Bose systems being passed off as new and they never even answered.

I gave them up as a bad job.

I am happy to answer any questions and listen to any ideas.

I can tell you that I have just instigated something to apply real pressure next week and if that does not work I am considering legal actions coupled with other actions.

However - any idea is more than welcome and i thank you for taking an interest.
 
All this talk about Tarquin Trader in the UK and TC in particular is of course very worrying for anyone who has purchased and awaiting delivery of their new Trader, but surely the Boat Builders of Ocean Blue in Taiwan must be held to count by TC for building such a poor vessel.

I cannot conceive that I would ever trust them to build me a boat whoever is the UK Agent.

They should surely go over TC's head and refund you your money for the boat at least so as to stop the bad publicity.
 
Edited by Dan - I've pulled this because although Gludy has proof, without everybody seeing it it's unfair to post his conclusions based on that here. Even if the report he has is expert opinion, other expert opinion might find otherwise. To answer the inevitable, these are my thoughts on the subject, not anyone else's.

As the mortgage company have a vested interest (ie you could declare yourself bankrupt and walk away - I know you won't ...) is there nothing they can do?
 
I could not declare myself bankrupt and walk away because I am not in that position - nowhere near to it. /forums/images/graemlins/smile.gif I bought the boat personally.


Yes there is something the mortage company can do - they have a duty of care etc. I cannot comment other than to say things are afoot there as Tarquin has just found out this morning.

I am sure that you know this already but I am just bringing a point to you

what is of particular interest is the part about loans etc from my experience with the consumer credit act is that the credit brokers can bring a LOT of pressure on the vendor by writing to the brokers saying that you are cancelling the payments and why they will then put pressure on tarquin

You are entitled to do this and you can also seek recourse from the money brokers tarquin and Trader all at the same time for a full refund as they are jointly and severally responsible.

As well as this I would seek a winding up order against tarquin and a writ against Chappel personally ( not for the same claim but for one of negligence ) also a writ to trader and a request initially to the mortgage brokers ( they also have liability ) and if necessary a writ to them as well .

I would also send copies of all of these to tarquins bank It could very possibly be a fact that that tarquin have an overdraft facility in which case all the directors will have joint and several liability so There is now a direct liability for the directors and the bank will pursue this and if necessary the directors will lose everything


Also of interest is the offences section as in GOODS WHICH ARE UNSAFE

I myself have had occasion to deal with the trading standards myself and have found them fair and helpful so I would suggest speaking with them again in respect to the not fit for purpose and unsafe aspects.

with the facts in front of them I am sure the trading standards will be a powerful weapon at your disposal and free
