I don't see what all the fuss is about. A Jetski is legally defined as a "vessel" in Colregs Rule 3 (a)

Whilst IRPCS may define vessels for it's purposes, and endeavour to be consistent with other regulations and practices, I don't think it can be binding on any other statute?

I am not completelt au fait with this case but from the write up here the case related to a statute and not an 'offense' under IRPCS.
