In the couple or three weeks since I last posted an “Is this you?” a few dozen new pictures have been uploaded to yourboatpix. Forumites, and particularly uploaders may wonder why there has not been an “Is this you?” in that time.

The short answer is that Dan has asked me not to post any more pictures from yourboatpix on the forum because he has had potential Data Protection issues with the site brought to his attention. I believe yourboatpix operates within the Data Protection act but I respect Dan’s right as moderator to control the content on the forum and so I have complied with his request. www.yourboatpix.co.uk continues to operate normally and welcomes your continued support.

I intend yourboatpix to operate legally. I have reviewed the practice of Google’s Street View, which has been ruled not to breach the Data Protection Act and will be adopting any of their safeguards as seem appropriate. Already it is possible for anyone to delete inappropriate pictures from the site and this feature can be used to remove pictures that anyone thinks identifies them personally. I will set in place a review of pictures to blur identifiable faces.
 
PM Dan for further details needless to say its not as simple as it sounds and its not Dan being difficult, having seen all the correspondence Dan and indeed most people here have far better things to do with their time!

I hereby give shmoo permission to publish pictures of my boat anywhere you please.

I will withdraw that permission in writing if I feel the need to do so
 
We seem to be going backwards as a society - a whole group of people must be under the impression that having their picture taken steals their soul. Do they not realise how many times their image is captured every time they go into a shop, walk down the high street or pull into a petrol station?
 
Interesting & fair point, but how many on here would feel the same way if it was Google, or a government department taking the pics & not another member of the Forum?

Too many people doing things what they oughtn't methinks.

Politicians do like us to be frightened - it make us easier to rule.

I hate people using The data protection act to protect their own dodgy practices. STUFF THAT! sez I. Power to Shmoo & his brilliant site.

I don't have the benefit of having seen the correspondence, but I do know that Data Protection Act is often threatened/mentioned by people who have no idea what it actually says. I also know that many companies would rather play safe and withdraw some facility, particualrly if they don't make money directly from it, than risk problems or cough up for a lawyer to check out the real situation. (I'm thinking health and safety here too, for instance.)

I am involved in running a sailing web-site. We were shocked to receive a complaint from an individual that showing details of their boat was in breach of Data Protection Act. I looked into it and found that the Act didn't apply to what we were doing anyway. Of course we had no problem with removing or disguising details on request (we're trying to make life nicer, not make people unhappy!) but the Data Protection Act claim was complete red herring.
 
The best example of how insane the DPA is comes from 1st hand experience.

Last year my Parents recd a letter from BT, it said "We are sorry you are leaving us and transferring your account etc etc"

Their account had been transferred by another phone company without my parents permission, when they asked BT who authorised the transfer they were told "under the DPA we can't tell you"!!!!!

The UK population is probably the most photographed, tracked, logged, recorded, etc etc in the World, what possible harm can pics of other peoples boats on this site do?

Does this mean we cant put any more pics up unless we have written permission from the owners?
