Your boat was moved onto a pair of fore and aft mooring buoys that were designed for an ADVERTISED MAX length of 42ft, and your boat was 46ft long, and the ring of the mooring buoy was beating into your bathing platform and the transom at every given opportunity.

Would you be happy to hear from the professional organisation that put it there, when they tell you on the phone that they accept NO RESPONSIBILTY FOR THE DAMAGE being caused to the vessel.

Would you be happy to find that the chain BRIDLE that you had so lovingly prepared for your boat, complete with rubber guards to protect your painted steel samson posts was now wrapped around and over one side of your vessel and the bare metal chain links now chaffing the stern as it rises and falls on probably the biggest tides of the year?

Would you be happy to discover they have taken one of your sheet lines from your stern locker to use as a mooring line ?

Would you instantly reassured to be told by the junior member of HM staff, thats probably got a level two power boat certificate and works the summer season handing out "parking tickets"then the winter season teaching snow boarding that "alls ok and that nothing needs to be changed"?


OR ... would you be spitting feathers and raising hell on the phone demanding that your vessel be made safe and that any damage caused by the aforementioned HM is their damned responsibility ?

Who are you quoting? Has the HM been saying that you'd be "delighted", "over the moon" and "instantly reassured"? Or are you quoting a brochure? Bizarre.

wasnt directly quoting anyone , after a very heated and frustrating telephone call with the HM , im told that even though they moved the boat to another location and they secured the boat there.

They are telling me that there is nothing wrong , that there is no damage caused by their actions , that they dont need to secure or move the boat, and that any damage is not their fault.

sorry you didnt get it, ive edited it so as not to cause any further confusion .

Why were they moving your boat around in the first place? I mean, I know it has to happen sometimes, but usually only when something's already gone wrong (broken adrift etc).

No reasons given as yet , but i suspect its because of the bank holiday and the number of visiting berths ? unfortunately im not back in the uk for another week or so and have to rely on the HM to sort this out before it gets any worse - she was painted summer of 2011.

Yep, I had the same thing, I painted my boat after a 15 month complete sandback to mahogany and the time and effort, then to sail it to Holland and in the middle of winter along with howling wind tunnel like weather they rafted a boat along side me with many spare spaces, and each time i asked them to move it they said yes, and 6 weeks later its still not moved,
following up with an email explaing to them that they wouldnt like it if it was there boat and ive been asking for 6 weeks and its scratched all the new paintwork, rubbing it back to timber in spots,
I said if its not moved by this evening i shall be cutting the lines to make secure my boat and prevent further damage,
The stupid robotic Dutch harbour master moved the boat that afternoon.

But seriously they should take more care of boats, but sadly they dont care..
 
Unless there are extenuating circumstances beyond the control of the harbour authority I cannot see how they can absolve themselves of responsibility for their actions. Anything in your mooring agreement which seeks to avoid such responsibility is likely to be deemed unenforceable by the County Court.

If cannot get any resolution through discussion, and assuming the repair costs is less than £5000, then mention the "small claims track" and everything should fall into place!

No extenuating circumstances just poor thought process and execution on behalf of the HM staff that led to the damage, putting a vessel larger than they advertise possible on a trot of moorings, ill pick up the baton when im back from work and see what they have to say for them selves, if i have to resort to small claims then so be it.
