Seller has just phoned me - he is an honourable chap after all and deal is going ahead

I think it's not very honourable of him, but think you should get your deposit back.

Think you'll struggle with anything else though.

If he quibbles about your deposit then your credit card company can sort that bit out.
 
How did he take a CC payment over the phone?
Presumably to have this facility he must run a business - not a fellow broker I hope.
I should have thought that legally, having taken a deposit he is obliged to do the deal but as there is no contract, I am not sure where you stand on that one.
The least he should do is refund your deposit and a decent chap would offer some recompense for the disappointment caused.
Not sure you will get anywhere with the additional costs you have incurred though sadly.
Does any legal eagle out there think differently?
 
Certainly not honourable and you should get your deposit back. As for compensation, i wouldn't hold my breath. You'll still need the tow bar etc for when you get another rib, so nothing lost, financially speaking.

EDIT If you paid the deposit as the result of an ad on here, a comment on that ad would seem appropriate.

As others have stated, lets hope he's not a complete to55er and gives you your £100 back without quibble.
What a git though, letting you down like that, some people are just born pig ignorant I'm afraid.
 
I would think acceptance of a deposit by the vendor on an advertised piece of kit is a form of contract, just as if you had paid the deposit and wanted to back out, the vendor could sell on and approach you for any shortfall.

I would get legal advice and let the vendor know of your intentions to claim for breach of contract, a verbal contract is all that was needed IMHO
