Some forumites may have been aware that my brother was lost in a boat towing accident near Beachy Head a couple of winters ago.The MAIB and MCA after patient and persistant investigation of the incident were able to bring the case to a final conclusion,when eventually,the skipper of the tug admitted liability just before appearing in court.
However when sentenced,the defendant had obviously decided with his brief to immediately appeal any custodial sentence and promptly appealed.
He is out on bail and has 28 days to lodge his appeal.
It was unfortunate,that the prosection was unable to enter evidence from the MAIB investigation that this particular incident was not an isolated one involving this skipper..
We would like to thank the MCA,the MAIB and especially both life boat crews including the helicoptor team ,for their assistance in the search on that January winter night in gale force conditions.
