Hi All,

Well boats are really having a Tough time at the moment. That immaculate 1997 Cranchi Zaffiro 34 sold for £53,300 to "Shotcock". From his history I do not know if he will complete as he seems to only Buy Golf Stuff...and tried a Z3 but it was not as described! That boat deserves a good home, one fastideous owner from new as well!

So Lou1971, why did you only go to £35k if it was your Dreamboat??

How does it work ?

Does shotcock now get a survey or is it bought as seen/not seen ?

Can the seller withdraw if he wanted £60k ?

Can lou offer £55k to shotcovk subject to survey ?
 
In theory the winning bid is binding (if there is no reserve) but that is only if the item is accurately described. As such I don't see any reason the winning bidder can't insist on a survey before completing the transaction, but would only then be able to pull out if the survey revealed a significant problem that the seller hadn't mentioned.

In reality though how likely is it that the seller would try and enforce the winning bid if the winner turned out to be a time-waster and vice-versa?
 
Bought as seen, unless badly described, then there is a system to object.
Seller has to put a reserve on when posting, if not you get what the last bid was, less Ebay %.

In this case the seller needs rid of it. It is his Parents boat and they do not want to keep paying for a boat they do not Use. He set a Reserve of £50,000 which was what he was told the 'Dealer buy it'...cash Price was. The sale should go through unless any reason is found why she is not as described. The Seller is happy for a survey, but his Parents have owned the boat since 1997 (new) and he has every reciept. I trust it is in first rate nick, even the covers were replaced with top of the range (not cheap ones).

Although it is a binding contract, a lot of people use silly excuses to get out of it. To be fair, looking at when the guy bid, he would have expected that someone else would bid over him (lots of bidding going on) and he may have got 'Bid Fever' He bid her up on the 2nd October with 4 days left to run. He obviously put in quite a high bid as 3 others tried to bid against him and his maximum was increased automatically.

I did not buy her as I was Travelling last night and did not want to get into a bidding war. The vendor is aware that if anything goes wrong then he can call me. At £50k she is a fair price, but without the swim platform and larger engines she is not the best spec, although all else is great. For £25k more I could get one 4/5 years newer with the right spec. The question is it worth it? This boat will always be a bit sticky with the smaller engines...at the right price Yes! So I will wait and see what happens /forums/images/graemlins/cool.gif

the winning bid is a binding contract ( so called) and with no reserve the sale is binding on the seller too.
However the consequences of defaulting are not great. If you do it 3 times ebay terminates your account but with large sums at stake neither party would shirk from backing out if they simply change their mind for any reason. ebay tells them they are naughty - end of.

emmm... thats the problem here I dont think I would want to by anything of such high value, £53k, "unseen" as is the case here, whether it be a boat a car or anything else.

Only an Idiot would pay for her 'Sight unseen' I would want a full day of Sea trial with a surveyor before he got my cash! Better some negative feedback than to be stuck with £50k of Duff boat, so forget Ebay Rules....follow common sense. I sold a Jetski for £695 and he would not pay until he had seen it (running). I had no problem as it was great...although another forumite (who sold it me) made me pay way over the odds for it! Where is the Pirate anyway .... /forums/images/graemlins/laugh.gif
