About to buy yet another boat and am looking for the RYA bill of sale proforma to transfer ownership from the current owners to me as I believe this covers me against any debts that might be attached to the craft. Does anyone know where I can find the form? I've tried Google with no luck so I was rather hoping that someone here might know of its location.

The craft is a fishing boat costing about £18k.

A word of caution here. The Bill of Sale does not "cover"" you against the claims of those who have a valid security interest although it will give a clear line of recourse to the seller if any such security interests exist. You still need to conduct prudent checks to establish that the seller does actually have the clear title that he purports to have by issuing the Bill of Sale.

What is the correct procedure for buying a yacht ?

Phone all the main marine mortgage companies (you;ll need to provide enough info for them to id the correct boat). Ask around the local area (marina, engineers etc) to see if anyone knows of any outstanding debts owed to them. Such news normally travels quite quickly if large amounts involved. Unless it's part I registered in which case any mortgage will be listed
 
The MCGA Bill of Sale is generally used by Brokers for ALL boats as it is a proper Bill of Sale for whether a boat is registered or not.
 
No - used for all boats even those not even SSR'd

Do fill in 64/64th

Remember the value is "one pound and other considerations"

Do get it witnessed.

The RYA form is a "proper" bill of sale. Having said that, I would modify the wording a little if I was intending to buy or sell an unregistered vessel.

My preferred wording is here.

THE MCGA form is not very appropriate for an unregistered vessel for the very good reason that there is no particularly convenient space to fully identify the vessel other than by its name (not sufficient) and official number (not relevant as unregistered).

Witness is not essential unless the attestation expresses the instrument to be a deed, but nice to have if convenient. If a deed, a witness signature is essential (two in Scotland).

Apart from the things Brendan mentioned, look for a documentary chain of title going back to the manufacturer/builder. This can be in the form of bills of sale, invoices, receipts, or builder's certificate.

If any link is missing or defective, proceed with caution.

A perfect chain of title for an unregistered boat will be (all originals): builder's certificate in name of first owner and a bills of sale in favour of each subsequent owner. But this is still not a guarantee that there are no encumbrances.
