Reject a Boat and get Nowt back

I did not know this before today.

If you reject a boat the boat ownership returns to the seller when you reject it and you have a debt that you have to prove - so you do not even have legal title to the boat from the time of rejection.

Hence the seller can resell your boat and go bust leaving you with nowt!!!!

So it seems that rejection is even more dangerous than I thought, you even remove your security!!!!!

Interesting fact

does this apply if you still hold all the original documents?
does the seller have to actually be in possesion of the boat?

eg....seller is dealer in say Scotland...boat rejected but still being worked on to correct faults in Solent?

Surely the title only reverts to them if they accept the rejection? In this case yes you would be exchanging the boat for a liability on the company until that liability was met.
If they refuted the rejection then you would still have the boat, and if pursuing legally would no doubt be responsible for maintaining it's value whilst the case was pending.

I fully understand your concerns however as with all disputes you need a certain amount of stamina to see them through.

Business bankrupt, no job, no house, last 15 years of life a waste of time.

In law if you reject a boat then "property" passes back to the seller; there is no requirement for the seller to accept your rejection. If the boat is at the seller's premises, he can sell it and all you have is a money claim against him.

Rejection is a tricky area, both in law and fact - not something to undertake in the heat of the moment but rather after careful reflection!

Sorry to hear you have problems, I havn't seen your threads so I don't know how bad the situation is. I followed your story of the boat being built and enjoyed the photo's. The boat certainly looked great! I guess at the end of the day we all expect perfection and generally have to settle for less! Are the builders of your boat not wanting to put things right for you?

so when in July last year i told the dealer that because of the number of serious faults i considered the boat rejected and if the corrections were not put right in a reasonable time i would return the boat and at that time consider whether to ask for money back or replacement.
was a waste of time?
when the problems still weren't corrected a few months ago i told them that i no longer had confidence in the boat and didnt want it. the dealer accepted this and both the boat manufacturer and engine manufacturer have been pulling all the stops out to give me a boat i can use confidently.
does this mean that my rejection is not valid?

I do not know - I was told that they may resist the rejection but you can stilll lose the boat as once you reject it, it is their property pending the outcome - in effect you swop your boat for a potential debt if you win!

Anyway i have just seen the response of Chris so will now shut up!
