Red/white diesel retail sales

Boat club buys in diesel in bulk and members help themselves paying to top tank up.

Can the club buy 600 L white and 400 L red, mix in the tank and then the members sign a 40/60 declaration .

Trouble is no one will sell the club red and let them pay 60/40 duty.



They can not become a retailer as the pump would need to be checked by weights and measures and all sorts of red tape.

Question Does becoming a RDCO (Registered Dealer in Controlled Oils) mean becoming a retailer?

If the club is selling the oil then it would have to register to be a RDCO, but being a club may not be classed as a retailer?

I didn't think that selling Gas Oil was subject to weights and measures regime?


I could be completely wrong in most of the above as it's more of an area of interest, than of expertise.

In any event even if the club buys a "pre-mix", I suspect that it has to be registered (new RDCO regulations). You should "seek advice", but fro whom??
 
The rules state that "suppliers of fuel" have to register as an RCDO. If the club is considered a supplier then presumably they would have to register. We're an RCDO and we are subject to Weights and Measures.
The BMF web site has a link from their home page to "Red diesel update" and I think there is a contact given there if you have specific questions. As this is something you don't really want to get wrong I would suggest you ask their advice first and if it's still not clear you'll have to contact HMRC.
