The Commission has started formal proceedings against the UK for the
incorrect implementation of the Directive that ended the derogation that
allowed red diesel to be used for propulsion by pleasure craft.

The formal notice was issued on 17/6/2011 to the UK. See bottom of page at

not intervene with any Member State that takes action against pleasure craft
using red diesel for propulsion.'
 
So we can get fined personally because the UK did something that the EU doesn't like. Hardly seems fair - it's not as though we really have any choice but to use the diesel that is made available to us.:(

Perhaps someone who gets fined should now sue the government.

But we are not allowed to use red diesel for propulsion. Only non propulsion, hence the 60/40 ?

As far as I am aware and understand, the 60%/40% split was a non confrontational agreement with revenue that "we" the boat users, pay full duty on the 60% for propulsion and a lower rate for the 40% for heating and generation of electricity. but it still remained red, because to change the whole infrastructure to give "us" white fuel oil was too costly to implement.

and of course you can burn me down in flames if this is wrong.:D
 
Yet another reason to get out. That makes 73,000,000 so far!!!

WELL SAID sir/madam......i voted against it in the 70s and there is NOTHING ATALL to make me change my mind...its just ANOTHER way of uping our taxtake.....GOODBYE N GOOD RIDDENCE TO IT .......................deeeeeeeep breaths deeeeeeep breaths ......sorry but i must go n ly down ........

Got this email from RYA.

"We understand that the Commission has indeed decided to open infringement proceedings against the UK regarding the EU Marking Directive (Directive 95/60/EC), which relate to the continued availability in the UK of marked (“red”) diesel for use in private pleasure craft (rather than the 60/40 duty apportionment). A statement to this effect will be appearing on the RYA website shortly.

Notwithstanding the above, however, the RYA has taken specialist taxation advice and we are advised that the continued availability in the UK of marked (“red”) diesel for use in private pleasure craft does not infringe the EU Marking Directive. We understand that HMRC has taken its own specialist advice and that this advice concurs with that obtained by the RYA.

In the meantime, irrespective of whether the European Commission believes that the continued availability of red diesel in the UK infringes the relevant EU Directive, enforcing the acquis communautaire is conferred by Article 226 of the EC Treaty on the European Commission, as the guardian of the Treaties and secondary legislation. It is thus for the Commission alone to enforce any alleged failure of member states to fully implement obligations arising under EU Directives and the authorities in EU member states should not penalise individual yachtsmen for what they might consider to be a failing on the part of the UK Government. It is for this reason that we continue to lobby the Commission in an effort to persuade it to intervene to prevent the authorities in EU member states from penalising individual yachtsmen who may have purchased marked diesel in the UK."
 
Glad I have used white for the last 3 years the amount it costs extra is negligable in the context of running a sailing vessel. The sooner marinas clean their tanhks and sell white the better
 
Erm.......not having sailed abroad for some years i have been following these red/white diesel debates from the side lines so to speak , but now i have a question , if you have white in your tank is it still required that you keep a engine /fuel log and receipts etc as it would be if you had red diesel ??

when i took over my boat last year the tank only had a couple of gallons of red left in the tank so i pumped it out and put in white , obviously i no longer have a reciept (from tesco's) .

would this be a issue to foreign officials ??

that would be no prob, (you could always buy some fuel for the car & get a receipt :eek: )

Can't see how it could be the log keeping was a fudge aimed at reconcilling the tank contents with reciepts showing the fuel had been purchased for the boat. As long as the tank has white in it showing that duty has been paid on ot no other proof should be required, thats my view anyway although I keep a small book showing last service details and engine hours when done with the odd receipt in it.
 
So what about the Channel Islands and other non-EU countries? What will the Frenchmen who nip across to the Channel Islands do or what happens If you go via the CI?
