Sad day.

2 people sail a yacht with the owners permission ( and the owner knowing the boat is not insured ) , have an accident and have to pay the owner £1/4 million.

The end of sailing folk helping out on anyone elses boat. Dont crew on a trip or move a boat in a marina even with the owners permission as you may be sued for any damage.

It used to be that the owner was responsible for the loss or damage as his reponsibility was to ensure the crew are competant and if they have an accident he or his insurers are liable.

There is surely a difference between deliberately steering a yacht into a buoy by taking action to make sure you hit it (gross negligence) and accidentally hitting a buoy that you were trying to avoid, even if the theoretical position of the buoy was entered as a waypoint. ( reckless).

Are the insurance companies now going to refuse to pay out if you have an accident? Will they just say you were negligent and thus responsible for the loss.
