Just received a letter from the marina stating that following the renewal of there mooring area licence they have been instructed to ensure all berth holders hold adequate insurance.

On presenting a copy of the boats insurance we will be given a sticker to be proudly displayed on the port quarter. Have all users of Portsmouth harbour been told to do the same thing?

If their mooring gear breaks away, then any damage is down to their insurance.

If your boat breaks its warps and crashes into others, sets on fire or you bang into a few while docking, that is down to your insurance. They are quite at liberty to require you to have insurance to cover those risks to others whilst in their private waters.

Its not QHM mooring gear, the tackle is either owned by the individual or by the boatyard. QHM just license you the mooring position, which you have to agree to vacate immediately when instructed to do so, during times of national emergency.

In that case, even more reason for them to require proof of insurance, and in turn I would think your insurance company would require sight of a certificate of inspection for the mooring itself.

Wasn't there something a few years ago about taking on some liability if you demand to see proof of insurance. I recall my yacht club used to ask to see insurance certificates some years back, but after some advice or the other, now just ask you to sign a declaration that you will have insurance in place for the duration.

It’s a belt and braces approach isn’t it? You’ve got to prove you’ve got the cover, they give you a sticker which makes it easier for their people to see if you’ve got the cover or not. Mildly irritating to have to comply but not outrageously so.

It is, indeed, needless bureaucracy that is irritating. Once you have it on record that someone has insurance just keep that record. Use the boat name, SSR number or whatever identifier you want. A sticker is a daft idea. A bit like a tax disc...unnecessary in this day in age. Still, I suppose it'll keep some people busy somewhere.

I believe the RYA gives that advice for racers. The implication being that asking to see a Certificate of Insurance and then failing to establish if it truely insured the sailor for the activity in question, but still allowing the sailor to race **might** mean the race organiser carries a proportion of the liability. Easy to see with a race that they might present a CoI that only covers cruising. Or requires certain crew or rules for night etc, all of which are unlikely to be explicitly obvious on the Certificate.

Likewise, QHM might have a similar issue if a boat is only insured on a mooring in summer etc.

A sticker however will be a bit like Road Tax. It ensures when the sticker is issued there was a policy. If you cancel the policy the following day, or it expires - what happens with the sticker?

I've got one. The yard say that QHM want the stickers so that they can identify any boat which goes adrift. They reminded me of my obligation to have insurance but didn't ask to see any proof.
Ominously they are saying that there may be a "small administrative charge" for stickers in future years.
