Problems with the Dutch and Red Diesel

Ok so its reported that the Dutch are putting heavy fines on British red diesel users, I was planning to do the dutch waterways this summer so the Dutch will not be getting any of my money now!

But what about the French? does anyone know?

I thought I would change my plans and go to Paris! but if the French are up to the same tricks I will have to think of something else!

Have spoken to the French Government, and they say that as long as red diesel remains legal for private boatowners in the UK, then it can be used in France.

Umm I thought that the Dutch were waiting for proof and documentation from the UK government and would continue to fine UK boaters until this had happened - it has not to my knowledge and therefore Holland remains out of bounds ... so as already said - no british spending until they mend their ways ...
 
GC1 sorted it out last week.

He was in direct contact with the EU and got a letter from the DG.

He sent me a copy of the letter to keep on board.
I dont know how to paste a copy of the letter here.

Can he be allowed back , I m sure he could do it.

He was extremely helpful in many respects.


All you need is this letter and keep receipts of diesel bought in the UK.

Dont get caught with jerry cans of red on board !

I somehow dont think a photo of an official letter would go down to well when arriving in Dutchland .... they may still charge - now a copy of the original letter would go down a treat .... /forums/images/graemlins/smirk.gif

The United Kingdom' s derogation from the general provisions of the energy taxation directive(1), allowing the UK to apply a reduced rate of excise duty to fuel used in navigation in private pleasure craft, expired by the end of 2006.

The Commission communication of 30 November 2006(2) explains the reasons why the Commission did not propose an extension of the derogation in question, as requested by the UK. Therefore, from January 2007 onwards, the general provisions of the energy taxation directive also apply for the United Kingdom. However, the UK does not intend to reflect these changes until November 2008, the commission also found in favour of allowing GC1 to return to the YBW forum.

HM Revenue & Customs' web-site carries a budget note (BN) on the expiry of derogations, see:

which explicitly quotes the 1st November 2008 as the date by which fuel used for the purpose of private pleasure flying/boating will no longer benefit from the current reduced and exempt rates of duty.

According to the Community excise legislation and the jurisprudence of the European Court of Justice, in case of fuel transported in the normal fuel storage tank, the excise
duty is chargeable in the Member State of acquisition according to the national rules. It falls upon the Commission to enforce the compliance of national legislation with Community law.

Consequently, in the meantime, people can acquire red diesel in the UK and use it legally in another member state of the European Union, if transported in the normal fuel storage tank.
 
Can't we get the YBW magazines to print sn official copy which can be cut out and laminated ? And hey, why on earth can't our Customs talk to their Customs ?

Bet they dont realise how many cars, trucks and vans are over there on red diesel.

I thought you could use it for the generator, and get away with that have known many boaters fill up and say its for the genny, tip the man with a wink and a beer and get on with it.

Come to Belgium, there's a transition period till end 2007 allowing Red Diesel. Almost as beautiful as Holland (no opern waters though, mostly canals). You can enter in Oostende or Zeebrugge.

We'd be glad to accept your hard earned cash in return for much better beer as well ! How about that ? /forums/images/graemlins/grin.gif

Sorted – no, not yet, I fear you are guilty of seeing what you want to see and not what is actually there. The letter is from the EU, it gives the EU interpretation of the rules, the Dutch have a different interpretation so until the Dutch write a letter expressing agreement with the EU the the matter is not resolved.

The Dutch have said they will modify their stance when they get a letter from the British - so resolution may be on the horizon but its not here yet.
