I am surprised no-one has yet commented on the case reported today where a High Court Judge has ordered delivery sailors to pay the
replacement cost of a Fairline Phantom 40, £223,105. (BTW - value given as £320,000 - is that the mark up?) The Judge commented 'it was a great pity neither man was individually insured' Does this in any way imply that if I take the helm of a friends boat and cause accidental damage I would be held personally liable? Am I reading too much into this press report or are there serious impications?

I think he made them pay because the insurance company classified the incident as "not an accident". It was their bad seamanship that caused the sinking, hence they are responsible.
 
If the judgement is as simple as the press report it then god help the helmsman on HMS Nottingham when it struck Wolf Rock off Australia.
