as much chance as ever. I doubt the ferry company will be scrurrying around with explosives trying to remove the evidence

Without wishing to speculate on what was an horrendous incident, it does seem to be pointing that way doesn't it? A tragic incident for ALL concerned and just another reminder to us all that sometimes we're not playing games out there and to take care. If it turns out to be a simple lack of observation by a fellow seaman then let him who is without sin cast the first stone..........

Idle speculation, but you would think that, if they believe that the accident was caused by the ferry, then they must have a pretty good idea where she went down?

You would have thought so. You would also think that it would be difficult to be bringing a criminal prosecution - if they do - unless they reckoned they would be able to prove when/where.

The way the police/CPS works sometimes is beyond me..... like a while back in Devon, some bloke has been charged with murder and found guilty even though a body has never been found.... until they find a body, how do they know she is dead? could have just decided to leave /forums/images/graemlins/confused.gif I'm sure its all speculation & gut feeling half the time.

The fact that a report has/is goin g to the CPS doesn't necessarily mean that somebody is recommending a prosecution. When someone dies in this country, there is a due process. If the body is available, a doctor certifies that death has occurred and may, if s/he has been recently treating the deceased certify the cause of death. If not then a post mortem is involved. The Coroner will expect those in authority - emergency services, doctors etc to have considered foul play, neglect, accident and if suspected to have thoroughly investigated it and where there is evidence that somebody was potentially criminally liable for the death for a report containing such evidence as exists to be sent to the CPS - they will say whether or not there is sufficient evidence rather than detective turning up at the Coroner's Court saying 'not much in it Guv' to the Coroner. Of course disagreements occur on the extent of evidence - the police may think there's a case, the CPS may not - the CPS also bring in the economic argument - not in the public interest. Then of course there is always what the defence will say if it comes to a prosecution. In the end its for the Jury to decide - that's what they are there for.

As to the absence of a body, Jack 'the Hat' McVitie had his head blown off by the Krays in the Blind Beggar; everybody in the Saloon Bar saw it and concluded that he was really dead even though the body went into the Gloppiter Gloppiter machine and was never found. The Krays were rightly convicted once all the terrifed people and henchmen decided to talk. Of course, the CPS and then the Jury have to be really convinced and its pretty difficult.

So its all a due process. Don't assume a prosecution will follow or is being recommended: it may be, it may not. Be glad that in this country when someone dies, someone bothers to enquire about it. Of course, some do it better than others but essentially this is one of the marks of civilisation - which is why the murder of Steven Lawrence was so important - cocked up by incompetence and now potentially corruption.
