There certainly will be copyright vested in the IP owner.

However that doesn't stop the picture being used twice, by different licensed users. Many image libraries license out stock images on a 'royalty-free' basis. The term is a bit of a misnomer but what it means is that you can pay a flat amount for a license to use the image on a limited and non-exclusive basis. The image library may grant any number of such licenses over the same stock image.

Example: I use stock images from Getty Images in my client pitches and presentations. I pay Getty £X for the right to use a particular image for that purpose, but that is only a limited-use license. Any number of other people may also have done the same thing. And frequently will have done - one reason why you sometimes get a feeling a deja-vue when watching corporate PowerPoint or KeyNote presentations - you often see the same, tired old 'businessy, men in suits shaking hands' pictures in lots of people's presentations and pitch documents.
 
Yep it's the same image...Pure conincidence, unfortunately we didn't see the N&G advert until it apeared in last months issue...and by that time November's cover had already gone to press, so it was too late to do anything about it.

The image came from Getty, we bought the rights to use it on the cover...N&G bought rights to use in in an advert...No copyright issues.
