What statute or piece of legislation covers this and could it have changed after Brexit?
 
I don't know where the legislation is located but AFAIK it's still in place and not a simple process to buy one which doesn't meet the emission regs., typically those used on tenders. The buyer has to be able to prove to the national distributor as well as the seller they are a commercial user and sign declarations about its intended use. The terms of sale also exclude reselling for recreational use. Those in the supply train need to cover themselves in case someone bends the usage rules.
 
There's at least one bloke advertising the Tohatsu 9.8 on Gumtree, brand new for £2000. "Commercial use only, no haggling on the price".

I bet it's not hard to find someone who's lax about it, and who will accept a commercial use declaration on a laser-printed letterhead.

It's impossible to police this completely - if a waterspouts centre with a couple of 2-strokes goes bankrupt, the administrators aren't going to know they're not supposed to sell the outboards to joe public.
 
If you’re friendly with your local boatyard, another option is to have them buy it for you. Yes, it’s not allowed, but it’s untraceable insofar you can’t insist they ‘sell’ it to you with an invoice etc. (you’d forgo warranty) but rather they order it, somehow the money gets squared away, and you use it.

I'm pretty sure it was a consequence of the Recreational Craft Directive - whilst you might have thought that was the sort of EU red tape the Brexit was touted to address it not only is still in effect, its been positively reaffirmed in legislation since then which mirrors the CE marking for RCD with UKCA marking to the same standards!
