Having real problems getting my money out of a well known laptop company.

Ordered and paid for a laptop just after new year, they messed up the delivery, laptop got lost in the mail/delivery company. Gave it a couple of weeks, still hadn't recieved the laptop so told them that I wanted to cancel the order and get my money back. Laptop company agreed and said that as soon as they found the laptop they would pay me back.

They apparently found the laptop over a month ago but still won't refund me my money. They've never returned any of my phone calls. They are always apologetic on the phone when I call but nothing ever happens. I'm guessing that my next step is legal but have no idea how to move forward.

Anybody got any ideas?

Fairly easy....

Send laptop company a Recorded Delivery letter saying "send me the full refund in 14 days or, without further notice, I'll issue legal proceedings". If they don't pay, immediately issue court proceedings. The Court Service has an online service for small claims - full details here. It's quick & easy. If you paid by credit card, name your card provider as a second defendant.

Happened to my son last year - the lost in the post thing was stolen by an employee of courier company.
Came the same old thing when we find it etc, we will refund etc.
he issued a county court summons for the cost plus the cost of hiring a laptop for 6 weeks whilst they dithered around.
Got the whole lot, and they settled within a few days of the court judgement. He had actually bought from Dixons, so he put them, the company Hygrade Computers and the courier company in the summons, and let the court sort it out.. the hearing took about 15 minutes

You\'re right, they \"should\"...

But, in my limited experience, it's taken the encouragement of court action to persuade my card issuer to pay up in a retailer dispute.

Thanks for the advice. Faxed the letter off today to see if it lights the fires. Following it up with the recorded delivery letter today. Lets see what happens......

Got a phone call off their Ops Mgr this afternoon apologising and promising to have the money in my account by the start of next week.
