Legislation in Ibiza for skippers?

Hey all, new here so hello.

I have recently taken a job as a skipper in Ibiza and was wondering if anyone could help me with what laws I should be adhering to?

I am used to skippering in the UK and complying to the SVC code.

What is the situation if I am employed by the owners to take them out? What laws/certificates should I ensure the boat has?

Welcome to the forum.
The laws of the country you operate in apply as do the laws where the vessel is registered, if you are paid .

If in doubt check it out, as ignorance is no excuse in the eyes of the law.
As Skipper/Captain/Master it is your responsibility to know and understand.
Read and inwardly digest the Col-Regs as they apply everywhere.
Good luck with your new job(dont tell the owner, be confident in the face of the man with the check-book)

I'll assume you have a british passport and right of residence in UK. It then depends on where the boat is registered. If it's UK registered, all you'll be asked for from time to time is an ICC covering the boat type (motor, sail, whatever). It is also useful to have a letter from an owner appointing you as skipper.

If you stay longer than 183 days a year in Spain, you become tax resident in Spain . . . something worth bearing in mind if you own a vehicle and take it out there. The Spanish authorities may also deem the boat you are skippering should be re-registered in Spain - but this is an ill-defined point, resting on the possibility that you are actually the owner, not just the skipper. The Spanish authorities are aware of the lax UK part 3 registration policing and the way it's used as a 'flag of convenience'.

If there's any question of chartering, you must meet all the local charter regs and the business needs to be registered in Spain. Otherwise, if you're found out, heavy fines may be due.

Jim, the owner sends out friends and family for me to take out on the boat. I simply get an email from him telling me who is coming when. If he is being paid by these people I have no knowledge of it. Who gets fined for chartering? The owner or skipper?
