What fisherman does?

You don't need to; all you do is weld a couple of cone shapes to your mast and you're automatically 'stand on'.

A stupid yachty throw away comment by an obviously stupid person person who knows SFA about fishing!

I suggest you keep such comment and say them to a fisherman, or better still spend a week on fishing boat see how you only need to put a sail up to ignore the ColRegs. Power gives way to sail - always I guess!

Or are you one of the many who think racing rules are the only rules and expect everybody to stay out of your race; including commercial traffic?

Cannot see the full picture but some bloody good ship handling going on there, on all three accounts. There was room for allot more damage on all sides...
 
I've been following this with interest for the last few days. There was a more recent incident with similar consequences when they tried to refuel from another vessel.

What I don't understand is why the Oz government isn't going mental over this? If the Nissin Maru were in Japanese territorial waters, then that's down to them, but they're not. They're in Australian territorial waters and apparently a designated conservation zone? So where are the Oz warships that should be rocking up and pointing big guns at the Nissin Maru asking it wtf it's doing there?

Because they're not in anyones territorial waters. They're in the deep Southern Ocean near Antarctica which while several nations have claimed areas of it none of it legally belongs to anyone. Likewise any 'conservation zones' are not going to be supported by international law. The Aussies can only protest in the same way the Argies could only protest when we named a vast tract of land after the Queen last year.

Basically every press release you read comes from Sea Shepherd so has been spun to show the Whalers in the worst possible light, making it seem like they are defying numerous treaties and sovereign states when in fact they are not doing anything outside of the law what so ever. Unlike Sea Shepherd who have an injunction against them from the US courts that says they must keep 500 meters away from any japanese vessel. They don't seem to be complying though.

I guess the injunction applies in a similar way to how the whaling thing falls through the cracks? Nobody's waters therefore unenforceable?

The whaling thing doesn't fall through any cracks. A ban on whaling is not law, it's more of a convention that nations either agree to, or don't.

But surely if a particular country has banned whaling, then someone hunting whales in their territorial waters could end up in hot water?
From my experience, injunctions only really work within the issuing country, unless there's some kind of international agreement in place. Certainly at the lower end of the scale, injunctions become worthless once you walk over the border.
 
But the Nips are only hunting for scientific reasons though, eating them is a bonus to the poor starving Nips!

Like with Mitsubishi owning 95% of the worlds tuna licences and fishing into extinction for profit.

You can check that bit out - your tuna (dolphin friendly or any other type) is not a sustainable fishery anymore, and every time Mrs Brown buys a tin of cheap tuna she is helping them on to extinction!

But territorial waters only stretch 12 miles off the coast. No country has a legal territorial claim to the southern ocean.

I agree with the injunction comments. Not worth the paper it's written on but if the sea shepherd boats are US flagged (whether or not I don't know) then US law and its injunctions would apply at some level.

The nips get their permit for scientific whaling from the international whaling commission. You can check that bit out too.
