G5 tax in Spain

Thought I'd start a new thread on this subject.

From my Gestora:

This tax has its origine from GENERALITAT VALENCIANA - GERENCIA DE PUERTOS.
Usually, Clubs Náuticos provide regularly to Gerencia de Puertos the list of owners and boats with a mooring. It will be better to ask someone in the port where your boat is laying. As far as I know, this tax corresponds to volume of the boat, but I cannot tell you how they calculate it.

Popped into the marina office (it's OK; I go in when I know Tanya isn't there!!) Up until now I've paid G5 monthly - the office tell me that from March one will pay G5 (in advance) for a 6 month window so I pay in March and then again in September. If one plans to leave Spanish waters then you have to give at least one months notice to stand a chance of getting a rebate on what you have paid.

Now I've got the G5 regulations (5 pages of A4) from our marina - all in Spanish. I'll get it translated and post (unless someone beats me to it!)

But, I'm in a spanish marina and nobody has come near me or the marina office asking for anything?? Plus is it not illegal to tax other EU citizens (visitors)? I dont understand this tax business, please explain. Also I've been in spanish waters for 18 months now.

What I cant get my head around is I though the idea of the EU was free travel is seems every time I open another mag there another country imposing tax on sailor ,
Where the RYA ?.....

Hi Charles, sorry to be pedantic but has the above quote been taken from a translation from the document or is it your understanding if the situation. I had thought that residents were subject to 'wealth tax' and non residents to G5.
....confused of birmingham!

Spain is divided in so-called "autonomias", which have the right to impose some taxes to get money for general purposes. One of these autonomias is Generalidad Valenciana, which according to the original post has decided to impose a tax on yachts. When such a tax is applied to every person, inhabitants as well as visitors, it is in accordance with EU-rules. Consider the toll one has to pay on french motorways, which has to be paid by all users, french and foreigners.

I don't know for what purpose the valencian government uses the money, but as long as spaniards and foreigners are taxed the same way, such a tax is legal! To give a specific example: the central spanish government allowed the autonomies to extra tax road fuels, gasoline and diesel, to pay for the sanitary system. Not all the autonomies use it, but Madrid is one of the autonomies, which does. Logically people try to tank in adjoining autonomies, which do not apply this extra tax. As Mogy indicated in another thread, the way the autonomies apply this G5 tax also differs from autonomy to autonomy and I wouldn't be suprised if some would not apply it at all. Henk.

Look on it as a parking fee for boats. Doesn't happen in every car-park, or marina. It's perfectly within Spanish law and has nothing to do with the EC (or for that matter the Spanish government).

Just don't stay in any Spanish ports for too long.
 
One of the main deciding factors in this is whether or not you get on with the marina staff!! The Spanish love money and any form of "indirect" taxation that MAY not have to be recorded too well is of great interest to them
Also, with Valencia hosting the Admirals Cup prices for berths have gone through the roof already and Pobla Farnals, 10km North of Valencia is now more expensive than any French Med marina, and has a huge rat problem to boot.
The British disease of ripping people off has rapidly spread across Spain in the last few years, due in great part to the number of Brits over there trying to rip-off new arrivals.

However, I am looking to purchase a boat currently in Torrevieja, and was wondering the best way to confirm that all G5 tax is up to date and been paid on the vessel? Is there a specific certificate I should ask for or somewhere to check this?

Any help/guidance in this field is most appreciated.

More important is to check VAT paid status and whether "matriculation" tax is due.

Another thing that seems daft is I want to deregister from Spain & UK register it. The broker says I need to surrender the epirb to the Spanish authorities (forever). Is this correct? I thought It would be a case of deregister it & register with UK?

EPIRBs have a unique number, like the MMSI, which is country specific, so if your planned boat has a Spanish EPIRB you can retain it but it will have to be reprogrammed with a UK specific number and registered with the UK authorities. It may be cheaper simply to buy a new UK specific beacon.

As far as the Matriculation Tax is concerned, I would imagine that there should be a receipt from the tax authority for the tax.
 
Sorry, I'm not an expert, especially in Spanish flagged boats. Suggest you search matriculation tax on here - it's been done to death and includes contributions from Spanish experts.
I'd definitely get a certificate of VAT paid, though, as occasionally you get visits from Guardia or Aduana who may want to see it.
